u- WHEREAS, on April 16, 2004, the City Council adopted plans and
specifications and authorized a call for bids for the Annual Fuel Delivery to Various
Locations within the City for Fiscal Year 2004 -2005; and

AUTHORIZING AN OPEN MARKET PURCHASE PURSUANT TO SECTION 3-
15 OF THE ALAMEDA CITY CHARTER FOR THE ANNUAL FUEL DELIVERY
TO VARIOUS LOCATIONS WITHIN THE CITY FOR FISCAL YEAR 2009 -2010,
AND AUTHORIZE THE INTERIM CITY MANAGER TO ENTER INTO SUCH
AN AGREEMENT
WHEREAS, on June 15, 2004, the City Council awarded a contract to Valley Oil
Company, the only bidder; and
WHEREAS, Valley Oil Company contract included the clause that the City may
mutually amend the contract for us to four years; and
WHEREAS, Valley Oil Company contract expired on June 30, 2009; and
WHEREAS, the price Valley Oil Company provided to the city was below
market in 2008 -2009, and Valley Oil Company has agreed to hold the 2008 -2009
prices for all of 2009 -2010; and
WHEREAS, Section 3 -15 of the City Charter authorizes the City Council upon
four affirmative votes to waive the competitive bidding process and make a contract
directly with a vendor when the supplies can be purchased at a lower price in the open
market without competitive bidding procedures.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Alameda, pursuant to Section 3 -15 of the City Charter, the Interim City Manager, in
cooperation of the Public Works Department, is hereby authorized an open market
purchase for the annual fuel delivery to various locations within the City for fiscal year
09 -10, and authorized to enter into such an agreement.
I, the undersigned, hereby certify that the foregoing Resolution was duly and
regularly adopted and passed by the Council of the City of Alameda during the Regular
Meeting of the City Council on the 21st day of July, 2009, by the following vote to wit:
AYES: Councilmembers deHaan, Gilmore, Matarrese,
and Mayor Johnson - 4.
NOES: None.
ABSENT: Councilmember Tam - 1.
ABSTENTIONS: None.
