ARRA Resolution 12ALAMEDA REUSE AND REDEVELOPMENT AUTHORITY RESOLUTION NO. 012 ADOPTING A CONFLICT OF INTEREST PROVISION AND DIRECTING PREPARATION OF AN EMPLOYEE CODE OF CONDUCT IN COMPLIANCE WITH FEDERAL REQUIREMENTS IN CONNECTION WITH THE GRANT FROM THE ECONOMIC DEVELOPMENT ADMINISTRATION TO THE ALAMEDA CENTER FOR ENVIRONMENTAL TECHNOLOGY WHEREAS, the Economic Development Administration of the U.S. Department of Commerce (EDA) has approved a grant to the Alameda Reuse and Redevelopment Authority, the Alameda Center for Environmental Technology (ACET), and the California State University Hayward Foundation (CSUHF) in connection with the ACET program; and WHEREAS, prior to disbursement of grant funds the EDA requires grant recipients to adopt certain specified Conflict of Interest provisions by resolution. NOW, THEREFORE, BE IT RESOLVED by the Alameda Reuse of Redevelopment Authority that said Authority hereby adopts the following Conflict of Interest provisions: The Alameda Reuse and Redevelopment Authority will not permit any of its members, officials, employees, agents from personally benefitting, directly or indirectly, from the EDA grant made in connection with the Alameda Center for Environmental Technology program. Each and every act prohibited by the Conflict of Interest provision of OMB Circular A- 110.41 and Notice of 1995 Fund Availability, Federal Register Volume 60, Number 49 (March 14, 1995, pp. 13867) is specifically included in this prohibition. The Executive Director of the ARRA is directed to prepare a written Code of Conduct to govern the performance of ARRA officers, employees, and agents engaged in the award and administration of contracts pursuant to the EDA grant. The Executive Director shall incorporate each provision set forth in the Conflict of Interest provision of OMB Circular A- 110.42 and Notice of 1995 Fund Availability, Federal register Volume 60, Number 49 (March 14, 1995, pp. 13867), the text of which is attached as Parts I and II of Exhibit A to this resolution, in the Code of Conduct. cAwp\arra\staff-re. pts\ac etres o. co i I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Alameda Reuse and Redevelopment Authority in its regular meeting, assembled on the 6th day of December, 1995 by the following vote to wit: AYES: 9 NOES: 0 ABSENT: 0 Date: December 6, 1995
