RESOLUTION NO.
AMENDING RESOLUTION 002 ESTABLISHING THE POWER
AND AUTHORITY OF THE EXECUTIVE DIRECTOR REGARDING
ADMINISTRATIVE APPROVAL OF LEASES AT ALAVIEDA POINT
WHEREAS, the Alameda Reuse and Redevelopment Authority Joint Exercise of Powers
Agreement and Bylaws set forth certain powers of the Executive Director; and
WHEREAS, those Bylaws state that the powers and authority of the Executive Director
of the Alameda Reuse and Redevelopment Authority ("ARRA") shall be established by
Resolution; and
WHEREAS on July 13, 1994 pursuant to the ARRA Resolution 002, the Executive
Director was granted the power and authority to administratively approve all leases, concessions
privileges, franchises, p el rr its, licenses or easements of real or personal property at Alameda
Point for a period of no longer than seven (7) years; and

WHEREAS the ARRA desires to amend the
powers and duties of the Executive Director
as set forth in Resolution 002, regarding administrative approval of leases of real and personal
property at Alameda Point.
Now THEREFORE, BE IT RESOLVED by the Governing Board of the Alameda Reuse
and Redevelopment Authority that the Executive Director of the Alameda Reuse and
Redevelopment Authority shall have the power and it shall be his/her duty to lease or grant
concessions, privileges, or franchises of real or personal property at Alameda Paint for a period
of no longer than two (2) years, provided that any proposed "shell credit" to the lessee for City
required code upgrades made by lessee to the building does not exceed 10 percent of the
proposed annual rent.
