Mayor Gilmore convened the meeting at 5:45 p.m. Roll Call — Present: Councilmembers Bonta, deHaan, Johnson, Tam and Mayor Gilmore — 5. Note: Councilmember deHaan starting at 5:50 p.m. was present via teleconference from 16432 West Brookside Drive, Sonora, California. Absent: None. The City Attorney addressed the City Council. The Special Meeting was adjourned to Closed Session to consider: (10 -609) Public Employee Performance Evaluation (Gov. Code Section 54957(b)); Title: City Clerk (10 -610) Conference with Legal Counsel — Anticipated Litigation; Significant exposure to litigation pursuant to Gov. Code Section 54956.9 (b); Number of cases: One. (10 -611) Public Employee Discipline /Dismissal /Release (Gov. Code Section 54957 (b)) Mayor Gilmore called a recess at 10:20 p.m. and reconvened the meeting at 10:25 p.m. Following the Closed Session, Mayor Gilmore announced that regarding the City Clerk Performance Evaluation, the Council appointed a subcommittee; the Council voted 3 -2 to provide notice of non - renewal to the Interim City Manager of the Interim City Manager's contract which expires March 31, 2011 and commence a competitive selection process for a permanent City Manager; Mayor Gilmore, Vice Mayor Bonta and Councilmember Tam voted yes and Councilmembers deHaan and Johnson voted no; the Council voted 3 -2 to place the Interim City Manager on paid administrative leave through the expiration of her contract on March 31, 2011; Mayor Gilmore, Vice Mayor Bonta and Councilmember Tam voted yes and Councilmembers deHaan and Johnson voted no; the Council also chose to report that it has voted 5 -0 to place the City Attorney on paid administrative leave.
