CIC Resolution 11-178COMMUNITY IMPROVEMENT COMMISSLO+I OF THE CITY OF ALAMEDA RESOLUTION NO. F APPROVING AND AUTHORIZING EXECUTION OF AN AFFORDABLE HOUSING REIMBURSEMENT AGREEMENT BETWEEN THE COMMISSION AND THE HOUSING AUTHORITY OF THE CITY OF ALAMEDA FOR THE BWIPIWECIP PROJE CT AREAS WHEREAS, the Community Improvement Commission of the City of Alameda ( "Commission ") is carrying out the Community Improvement Plans (collectively, "Community improvement Plans ") for the West End and Business and Waterfront Improvement Projects (collectively, "Projects "); and WHEREAS, pursuant to Section 33220 of the California Community Redevelopment Law (Health and Safety Code Section 33000, et seq.) (the "CRL "), the Housing Authority of the City of Alameda ( "Authority ") may enter into agreements with the Commission for the purposes of aiding and cooperating in the planning, undertaking, construction or operation of redevelopment projects within the City of Alameda, including to facilitate the production and rehabilitation of affordable housing; and WHEREAS, the Commission and Authority have prepared and wish to enter into an Affordable Housing Reimbursement Agreement ( "Agreement ") to provide for the production and rehabilitation of affordable housing within the City of Alameda and Commission's reimbursement of Authority for the costs of affordable housing projects undertaken pursuant to the Agreement ( "Affordable Housing Projects "); and WHEREAS, program Final Environmental Impact Reports were prepared and certified on the Community Improvement Plans ( "Final El Rs ") in accordance with the California Environmental Quality Act ( "CEQA "), which included analysis of the Affordable Housing Projects on a programmatic level; and WHEREAS, at this time there are no preliminary drawings, plans or other sufficient information to enable a meaningful environmental assessment of the specific Affordable Housing Projects, and consequently, the Agreement provides that the commitment of funds to and commencement of the specific projects set forth therein shall be subject to completion of additional environmental review and analysis, as required by CEQA; NOW, THEREFORE, THE COMMUNITY IMPROVEMENT COMMISSION OF THE CITY OF ALAMEDA DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Commission hereby approves the Affordable Housing Reimbursement Agreement and hereby authorizes and directs the Executive OAK #4814- 9833 -4728 vi Director to execute the Agreement on behalf of the Commission, subject to any minor, technical or clarifying changes that may be approved by the Commission's counsel. The Commission hereby further authorizes and directs the Executive Director to take all actions and execute all documents as necessary to carry out the Agreement and accomplish the Affordable Housing Projects and the Commission's reimbursement of the Authority for the costs of the Affordable Housing Projects as provided for in the Agreement. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Community Improvement Commission of the City of Alameda in a Special Joint Meeting of the City Council, Alameda Reuse and Redevelopment Authority, Community Improvement Commission and the Housing Authority Board of Commissioners held on the 1st day of February, 2011, by the following vote to wit: AYES: Commissioners Bonta, deHaan, Tam and Chair Gilmore —4 NOES: None.
