AN ORDINANCE .'AUTHORIZING THE
COUNCIL OF THE CITY OF ALAMEDA
TO ACCEPT THE SURRENDER
OF AND TO CANCEL A LEASE OF
CERTAIN 'TIDE AND SUBMERGED
LANDS BETWEEN THE CITY OF
ALAMEDA, AS LESSOR, AND. ALASKA
PACKERS ASSOCIATION, AS LESSEE.
WHEREAS, the City of Alameda, as
lessor, heretofore entered into a lease with
Alaska Packers Association, a corpora-
tion, as lessee, dated February 5, 1920,
pursuant to Ordinance .No. 164, New Series;
and
WHEREAS,it was provided in said lease
that upon the termination of the original
term of twenty -five (25) years the lessee
should have the right to renew said lease
upon the same terms and conditions for a
further period not exceeding twenty -five
(25) years; and -
WHEREAS, pursuant to the terms of
said lease and of : said Ordinance No..164,
New Series, and of Ordinance No. 863,
New Series, a renewal of said lease was
duly executed and dated December 30,
1944; and
WHEREAS, it is now the mutual desire

of the parties thereto to cancel and termi-
nate said lease dated February 5, 1920,
and the renewal thereof elated 'December
30, 1944; anii
WHEREAS, it is to the advantage, bene-
fit and best interests of the said City' of
Alameda to accept the said surrender and
to cancel the said lease and the renewal
thereof;
THE 'PEOPLE OF THE CITY OF ALA-
.MEDA DO ORDAIN as follows:
SECTION. 1. That the Council of the
City of Alameda is hereby authorized and
directed, for : and on behalf of , the City of
Alameda, to accept the surrender of and
to cancel the aforesaid' lease and renewal
thereof between said City of Alameda
and said Alaska .Packers Association, a
corporation, dated, - respectively, . February
5, 1.920. and December 30, .1944.
SECTION 2. This Ordinance shall be in
full force and effect ten (10)days after the
date of its adoption.
1, the undersigned; hereby certify that the
foregoing Ordinance was adopted by the
people of the City of Alameda at the
General Election held November 5, 1946,
by the following vote:
