Ordinance 0949Alameda City Ordinance No. 949 Ordinance New Series AN ORDINANCE AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY FOR STREET AND HIGHWAY PURPOSES. WHERE AS, public interest and necessity require that the real property hereinafter described be acquired by the City of Alameda for street and highway and general mu- nicipal purposes; and WHEREAS, Albert H. Songey and Helen G. Songey, his wife, are the owners of the real property here- inafter described and are willing to sell the same to the City of Ala- meda for the sum of $2,000.00; 1.3E IT ORDAINED BY THE COUNCIL OF T14E CITY OF ALA - 1V. EDA : Section 1. That the City of Ala- meda purchase from Albert H. Songey and Helen G. Songey, his wife, for the sum of Two Thousand ($2,000.00) Dollars, that certain real property situated in the City of Ala- meda, California, more particularly described as follows: PORTION of the parcel of land conveyed by Charles Munson Barre and Mabel Barre to Albert I.A. Songey and Helen G. Songey dated June 13, 1944, recorded July 1.3, 1.944, in boob 4592 of Official Records of Alameda County, at page 96, described as follows: BEGINNING at a point on the eastern line of said parcel of land, distant thereon north 1° 35' 45" east 99.39 feet from the northern line of Lincoln Avenue, and running thence north 64° 58' 39" west 43.59 feet to a point on the western line of said parcel, distant thereon north V 35' 45" east 7.16.72 feet from said line of Lincoln Avenue; thence along said western line of said parcel north 1° 35' 45" east 18.28 feet to the northeastern line thereof; thence along a curve to the right of radius 2271.88 feet southeasterly 43.33 feet, more or less, to the eastern line of said parcel; and thence along the last named line south 1° 35' 45" west 19.76 feet to the point of beginning, on the following terms and condi- tions: (a) That good and merchantable title in fee simple in said real prop- erty be conveyed to the City of Alameda, free and clear of all objec- tions, liens and encumbrances, but subject to second installment of taxes and assessments ents for the fiscal year 1948 -1949; (b) That the title to said real property.be.evidenced by a policy of title insurance issued by Alameda County -East Bay Title Insurance Company, insuring title in the City, as provided in the preceding; sub- division; (c) That upon deposit with said title company for delivery to the City of a good and sufficient deed of grant conveying said property to the City, and conditioned upon the issuance of a title insurance policy as aforesaid, to be approved by the City Attorney, a warrant of the City be drawn for Two Thousand ($2,000.00) Dollars, payable to the order of said Albert H. Songey and Helen G. Songey, his wife, and de- livered to said Alameda County - East Bay Title Insurance Company, as escrow holder, for the purpose of effecting the consummation of said purchase. Section 2. The sum of Two Thou- sand, Thirty ($2,030.00) Dollars is hereby appropriated from (Ias Tax No. 2 Fund to pay the purchase price of said real property and cost of title insurance policy. Section 3. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. W. J. BRANSCHEID, Presiding;' Officer of the Council.
