Ordinance 0950Ordinance No. 950 New Series ORDINANCE NOw 950 AN ORDINANCE AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY FOR. STREET AND HIGHWAY PURPOSES. WHEREAS, public interest and necessity require that the real property hereinafter described 'be acquired by the City of Alameda for street and highway and general municipal purposes; and WIIEREAS, Celestina. Cosso, a widow, is the owner of the real property hereinafter described and is willing to sell the same to the City of Alameda for the sum of MOWN): 13E I'T ORDAINED BY THE COUNCIL OF THE CITY OF ALA- MEDA: Section 1. That the City of Ala- meda purchase from Celestina Cosso, a widow, for the sum of Two Thou- sand ($2,000.00) Dollars, that certain real property situated in the City of Alameda, California, more particu- larly described as follows: A POIZTION of the land de- scribed in the deed by F. Testa and M. Testa to C. 0m!,,90 dated September 27, 1927, recorded September 27, 1927, in book 1701 of Official Records of Alameda County, at page 264, described as follows: BEGINNING at a point on the eastern line of the land firstly described in said deed distant thereon north 1' 35'. 45" east 21.40 feet from the northern line of Lincoln Avenue; and running thence north 64' 58' 39" west in a direct line 87.18 feet to a point on the western line of the land secondly described in said deed, distant thereon north 1* 35' 45" east 656.06 feet from said line of Lincoln Avenue; thence along said western line. north V 25' 45" east 19.44 feet to the northeast- ern line of the land described in said deed; thence along the.l."t named line south 65* 15' 20" cast 87-00 feet to the eastern line of the land described in said deed; and thence along the last reamed line t3outh 1' 3 45" west 20.10 feet to the point of beginning, on the following terms and condi- tiong: (a) That good and merchantable title in fee simple in said real prop- erty be conveyed to the City of Alameda, free and clear of all objec- tions, liens and encumbrances, but subject to second installment of taxes and assessments for the fiscal year 1948-1949; (b) That the title to said real property be evidenced by a policy of title insurance issued by Alameda County-East Bay Title Insurance Company, insuring title in the City, as provided in the preceding sub- division; (c) That upon dzposit with said title company for delivery to the City of a good and sufficient deed of _grant conveying said property to the City, and conditioned upon the issuance of a title insurance policy as aforesaid, to be approved by the City Attorney, a warrant of the City be drawn for Two Thousand ($2,000.000) Dollars, payable to the order of said Celestina Cosso, a widow, and delivered to said Ala- nieda County-Mast Bay Title In- surance Company, as escrow holder, for the purpose of effecting the consummation. of said purchase. Section 2. The sum of Two Thou- sand, Thirty ($2,030,00) Dollars is hereby appropriated from Gas Tax No. 2 Fund to pay the purchase price of said real property and cost of title insurance policy. Section 3. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final pas- sage. W. J. BRANSCHEID, Presiding Officer of the Council.
