Ordinance 0951Alameda Ordinance No. 951 City New Series AN ORDINANCE AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY FOR STREET AND HIGHWAY PURPOSES. WHEREAS, public interest and necessity require that the real prop- erty hereinafter described be ac- quired by the City of Alameda for street and highway and general municipal purposes; and WHEREAS, Gertrude Christensen is the owner of the real property hereinafter described and is willing to sell the same to the City of Alameda for the sum of $1,000.00; BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALA - MEDA: Section 1. That the City of Ala- meda purchase from Gertrude Chris- tensen, for the sum of One Thou- sand ($1,000.00) Dollars, that cer- tain real property situated in the City of Alameda, California, more particularly described as follows: BEGINNING at the southeast- ern corner of acre lot 8, said point being, also on the western line of Bowman's Ditch, as said lot and ditch are shown on "Duplicate Map of E. S. Chip - man's Acre Lots, According to the Survey of Washington Woodward, Deputy Surveyor of Alameda County," filed in boob 19 of Maps, at page 61 in the office of the County Recorder of Alameda County; and running thence along the southern line of said lot 8 westerly 152.44 feet; thence southeasterly on a curve to the right with a radius of 895.75 feet, a distance of 155.15 feet to a point on said western line of Bowman's Ditch, distant thereon South 1. 36' West 28.70 feet from the point of begin- ning; and thence North V 36' East 28.70 feet to the point of beginning, on the following terms and condi- tions : (a) That good and merchantable title in fee simple in said real prop- erty be conveyed to the City of Alameda, free and clear of all objec- tions, liens and encumbrances, but subject to second installment of taxes and assessments for the fiscal year 1.948 -1949; (b) That the title to said real property be evidenced by a policy of title insurance issued by Alameda County -East Bay Title Insurance Company, insuring title in the City, as provided in the preceding sub- division; (c) That upon deposit with said title company for delivery to the City of a good and sufficient deed of grant conveying said property to the City, and conditioned upon the issuance of a title insurance policy as aforesaid, to be approved by the City Attorney, a warrant of the City be drawn for One Thousand ($1,000.00) Dollars, payable to the order of said Gertrude Christensen, and delivered to said Alameda County -East Bay Title Insurance Company, as escrow holder, for the purpose of effecting the consumma- tion of said purchase. Section 2. The sum of One Thou- sand, Twenty -four ($1,024.00) Dol- lars is hereby appropriated from Gas Tax No. 2 Fund to pay the pur- chase price of said real property and cost of title insurance policy. Section 3. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final pas- sage. W. J. BRANSCHEID, Presiding Officer of the Council.
