AN ORDINANCE AUTHORIZING
THE ACQUISITION OF CERTAIN
REAL PROPERTY AND HIGHWAY
PURPOSES.
WHEREAS, public interest and
ziec:es;ity require that the real prop-
erty hereinafter described be .ae-
quired by the City of Alameda for
street and highway and general
; imleipa.l purposes; n.nd
WHEREAS, Anita Spadoni is the
owner of the -real _property herein-
after described and is willing to
sell the same to the City of . Ala-
meda for the sum of $1,205.00;

COUNCIL OF THE CITY OF ALA -

Section 1. That the City of Ala-
meda purchase from Anita Spadoni,
for the sure of One Thousand, Two
Hundred Five (.$1,205.00) Dollars,
that certain real property situated
in the City of Alameda, _California,
more particularly described as fol-
lows:
PORTION of the parcel of
land thirdly described in the
deed by E. Danton to Anita
Spadoni, dated October 30, 1933,
recorded October 31, 1933, in
boob 2959 of Official Records of
Alameda County, at page 238,
described as follows:
BEGINNING at a point on the
western line of said parcel of
land distant thereon south 1°
25' west 85.53 ,feet from the
southern line of Pacific Avenue;
and . running thence along the
western dine of said : parcel of
land south V 25' west 28.47 feet
to the southern line thereof;
thence along a curve to the
right of radius 2311.88 feet
southeasterly 34.20 feet, more or
less, to the eastern line of said
parcel of land; thence along the
last named line north l' 25'. east
26.49 feet to a point distant
thereon south 1' 25', west 99.51
feet from the southern line . of
Pacific Avenue; and thence in
a direct line north 64° 58' 39
west .34.93 feet to the point of
beginning,
on the following terms and condi-
tions:
(a) : That good and merchantable
title in fee simple in said real prop-
erty be conveyed to the City of

Alameda, free and clear of all objec-
tions, liens and encumbrances, but
subject to second installment of
. taxes :and .assessments for the fiscal
year. 1948-1949;
(b) That the title to said real
property be evidenced by ;a policy of
title insurance issued by _Alameda
County -East Bay Title Insurance
Company; insuring title in the City,
as provided in the preceding sub-
division;
(c) That upon deposit with said
title company for delivery to the
City of a good and sufficient deed
of grant conveying said property to
the City, and conditioned upon the
issuance of a title insurance policy
as aforesaid, -to be approved by the
City Attorney, a warrant of the
City be drawn fo_` One Thousand,
Two Hundred Five ($1,205:00) Dol-
lars, payable: to the order of said
Anita Spadoni, and delivered to said
Alameda County -East Bay Title In-
surance Company, as escrow holder,
for the purpose of effecting the
conqurnmat.ion of said purchase.
Section 2. The sum of One Thou -
sand, Two Hundred Thirty -t
($1,232.00) Dollars is hereby appro-
priated from Gas Tax No, 2 Fund
to pay the purchase price of said
real property and cost of title in-
surance policy.
Section 3. This ordinance shall be
in full force and effect from and
after the expiration of thirty (30)
days from the date of its final pas-
sage.

I, the undersigned, hereby certify
