Ordinance 1032Ordinance No. 1032 New Series NEW SERIES AN ORDINANCE AUTHORIZING LEASE TO JOEL Ll AND FRANK IVALDI OF CERTAIN REAL PROP- ERTY OF THE CITY OF ALAMEDA. WHEREAS, JOEL Ll and FRANK IVALDI, hereinafter called Lessees, has applied to the City of Alameda for a lease of those certain premises situated in the City of Alameda, here- inafter particularly described, for a term of ten (10) years, commencing on the 10th day of September, 1951 and ending September 9, 1961; and WHEREAS, a form of lease to be executed by the City and said Lessees and containing the covenants and agreements stipulated and agreed upon between the parties has been sub- mitted to the City Council and filed with the City Clerk at a regular meeting of the City Council held on July 17, 1951: NOW THEREFORE, BE IT OR- DAINED BY THE COUNCIL OF THE CITY OF ALAMEDA. SECTION 1. That the real property situated in the City of Alameda, County of Alameda, State of Califor- nia, and particularly described as follows, to-wit: BEING a portion of Main Street, formerly Main Avenue, as deline- ated and designated upon the Map entitled "New Map of Woodstock" recorded in Map Book 6 at Page 18, in the Alameda County Recorder's Office, and situated in the City of Alameda, County of Alameda, State of California, and further de- scribed to-wit: COMMENCING at U. S. Coast and Geodetic Survey monument "Main AtI. and running thence along the line to U. S. Coast and Geodetic Survey monument ­AtI Third" S 87' 16' 11 E 72.68 feet to the westerly line of Tract 41 as said Tract is delineated and des- ignated upon the map entitled "Map of Alameda Marsh Lands as partitioned among the owners thereof in the suit numbered 8923 and entitled Pacific Improvement Company, Plaintiff, vs. James A. Waymire, et al., Defendants, Su- perior Court of Alameda County, State of California," filed in the Alameda County Recorder's office in Map Book 25 at pages 74 to 78, thence along the westerly line of Tract 41 S 0 34 29" W 237.68 feet to a granite monument on the seg- regation line as shown on the aforesaid Map of Alameda Marsh Lands; said point being the TRUE POINT OF BEGINNING: thence along the segregation line S 84' 25' 31" E 20.95 feet to the segregation line Station 3; thence continuing along the segregation line N 80" 04' 29" E 78.07 feet to the easterly line of Main Street as shown upon aforesaid New Map of Woodstock; thence along said. easterly line S 3' 03' 26" W 216.63 feet to a point; thence at right angles to the last named course N 36° 51 W 75.00 feet to a point; thence N 3' 07' 59" W 201.08 feet to the TRUE POINT OF BEGINNING. be leased to JOEL LI and FRANK IVALDI for a term of ten (10) years, beginning on September 10, 1951 and ending September 9, 1961 at the total rent of Six Thousand ($6,000.00) Dol- lars payable Six Hundred ($600.00) Dollars annually on the tentt day of September of each year in ad- vance, commencing Sept. 10, 1951. SECTION 2. That the lease of said premises shall be in the form and contain the covenants, stipulations and agreements set forth in the draft of lease submitted to the City Council, and filed with the City Clerk, at the regular meeting of the said City Coun- cil held on July 17, 1951. SECTION 3. The Mayor of the City of Alameda is hereby authorized and directed to execute the aforesaid lease for and on behalf of said City, and the City Clerk is directed to attest the same as soon as this ordinance shall become effective. SECTION 4. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. FRANK P. OSBORN, Presiding Officer of the Council.
