Ordinance 1084Allameda City Ordinances Ordinance No. 1084 New Series ORDINANCE r: New Series AN ORDINANCE AUTHORIZING THE EXECUTION OF A LEASE OF CERTAIN REAL PROP'ERT'Y TO W. D. McELWAIN, DOING: BUSINESS AS BAY CITY FUEL OIL COMPANY, AND APPROVING THE FORM AND TERMS OF SAID LEASE WHEREAS, W. D. McElwain, an in- dividual doing business as Bay City Fuel Oil : Company, has applied to the City of Alameda for a lease of cer- tain City owned real property situated in the City of Alameda and more ticularly described in the form of lease hereinafter referred to, for the sole and exclusive purpose of :conducting thereon the business of the storage and distribution of petroleum products, for a. term beginning. April 17, 1953, and ending April 16, . 1963, with the right and option of renewing said lease for an additional period of : fifteen (15) years. at a rental of One Hundred Fifty ($150.00): Dollars per month for the initial ten -year . period and a rental in an amount hereafter to be deter- mined in the manner provided for in said .form of lease for the renewal period of fifteen (15) years, in the event such renewal be made; and WHEREAS, a form of Tease, herein - before referred to; containing the cov- enants and to ms agreed upon between the City of Alameda and the proposed Lessee has been prepared and sub- mitted to this Council at its regular meeting held: March 3, 1953, : marred "Filed March 3, 1953," and ordered filed with the City Clerk of said City; NOW THEREFORE, BE IT ORDAIN - ED BY THE COUNCIL OF THE CITY OF ALAMEDA Section 1. That the form of lease referred to in the preamble hereof and the terms covenants, agreements and provisions thereof be, and the same are hereby, appraVed. Section 2. :That the Mayor of the City of Alameda be, and he is hereby, authorized and directed to execute, and the City .Clerk to attest, as the act and deed of the City of Alameda a lease substantially in the form and contain- ing the terms, covenants,. agreements and provisions set forth -in . the afore- said form of lease. Section 3, This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. FRANK P.
