Ordinance 1127Ordinance No. 1127 New Series AN ORDINANCE VACATING A SEWED. EASEMENT IN CERTAIN LANDS AND AUTHORIZING EXE- CUTION OF QUITCLAIM DEED TO THOMAS WOOD (ALSO KNOWN AS PAUL WOOD) AND VIVIAN WOOD, HIS WIFE. WHEREAS, the City of Alameda heretofore acquired an easement for sewer purposes in the parcel of land hereinafter particularly described; and WHEREAS, it appears to the Council of the City of Alameda that said easement is not now and will not in the future be required by said City for sewer purposes or for any other purposes; and WHEREAS, title to the hereinafter described parcel of land is now vested in Thomas Wood (also known as Paul Wood) and Vivian Wood,. his wife, BE IT ORDAINED BY THE COUN- CIL OF THE CITY OF ALAMEDA : Section 1. That the easement for sewer purposes in, over and upon that certain land situate in the City of Alameda, County of Alameda, State of California, and particularly described as follows: BEING an easement held by the City of Alameda, which easement is described in that certain inden- ture from Santa Cruz Oil Corpora- tion to the City of Alameda, dated the 13th day of July, 1948, and recorded in the office of the Coun- ty Recorder of the County of Ala- meda, State of California, on July 30, 1948, in Book 5210 of Official Records, at page 315 thereof, said easement being further described as follows: All that parcel of land enclosed within the following described boundary: COMMENCING at the point of intersection of the southeasterly line of Peach Street, formerly Beach Street, with the southwest- erly lane of Otis Drive, formerly Front Street, in Lot 28, Section 18, Township 2 South, Range 3 West, Mt. Diablo Base and Meridian, according to the map entitled "Map No. 2 Salt Marsh and Tide Lands, Situate in the County of Alameda. State of California," filed in the office of the Board of Tide Land Commissioners at San Francisco, a certified copy thereof being filed in the office of the County Recorder of the City and County of San Francisco; running thence South 30 30' East 28.01 feet to the point of beginning; thence continuing South 30' 30' East 19.32 feet to a point; thence South 0° 40' West 183.29 feet, more or less, to a point in the United States Pierhead and Bulkhead line; thence along the last named line North 68° 30' West 10.70 feet to a point; thence North 0° 40' East 196.01 feet, more or less, to the point of beginning, be, and the same is hereby aban- doned and vacated. Section 2. That the Mayor of the City of Alameda be, and he is hereby authorized and directed to execute, and the City Clerk to attest, as the act and deed of the City of Alameda, a quitclaim deed, remising, releasing and quitclaiming to Thomas Wood (also known as Paul Wood) and Vivian Wood, his wife, all of said City's right, title and interest in and to the ease- ment described in Section I hereof. Section 3. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. LELAND W.
