Ordinance 1140Clity Ordinances Ordinance No. 1140 New Series AN ORDINANCE AUTHORIZING THE SALE; AND `CONVEYANCE -OF CERTAIN REAL PROPERTY OWNED BY THE CITY OF A.LAMEDA. Whereas, the City of Alameda, here- inafter referred to as the "City," is the owner of that certain parcel of land situate in the City of Alameda, County f Alameda, State of Cali- fornia, de as follows: Commencing at the intersection of the southeasterly line of Fern- side Boulevard, 80 feet in width, with the northeasterly line of Cen- tral Avenue; 60 feet in width, as said dines, boulevard and avenue are shown on Drawing 4192, Case 51, City Engineer's files: Alameda, California; said intersection has the coordinates of y- 461,928.35 feet and x- 1,500,612.09 feet based on the California Coordinate System, Zone III, as are all bearings, dis- tances and coordinates in this de- scription; Thence along the aforesaid south- easterly line of Fernside Boule- vard North 42° 20' 52" East 125.76 feet to a point which is on the direct extension southeasterly of the line between Lots 35 and 36 as shown on the aforesaid" drawing; said point has the coordinates of y- 462,021:30 feet and x- 1,500,696 81 feet and is the TRUE POINT OF BEGINNING; Thence continuing along the said southeasterly line of Fernside Boulevard North 42 20' 52" East 311.31 feet to a point on the direct extension southeasterly of the line between Lots M and 34 as shown on the aforesaid drawing; Thence along the last said line South 47 44' 04 °, East 104,97 feet to a point on the Line of Ordinary High Tide; Thence along the last described line North 44 59' 02" East 0.07 feet to a point on a line which is parallel with and 115.18 feet south westerly at rigght angles from the southwesterly line of Liberty Ave- nue, as said avenue now exists 56 feet in - width Thence along said parallel line South "47 44' 23" East 18.03 feet to an angle point; Thence continuing along said parallel line South 47° 07' 11" East 50.00 feet; Thence North 42° 20' 52" East 0.18 feet; Thence along a line which is parallel with and 115.00 feet south- westerly at right angles from the aforesaid southwesterly line of Liberty Avenue South. 47 07' 11" East 309.50 feet to the northwest- erly line of Garfield Avenue, 56 feet in width; as said avenue now exists; Thence along the last said line South 42 22' 49" West 310.16 feet Z -the intersection with the north - c ,sierly line of Block A of "Tract 1035" as shown on the aforesaid drawing; Thence along the last said line North 47° 25' 22" West 362.01 feet to the northerly corner of said Block A; Thence along a line that is par - allel with and 125.32 feet north- easterly at right angles from the aforementioned northeasterly line of Central Avenue North 47' 42' 54" West 12.91 feet to a point on the aforementioned Line of Ordi- nary High Tide; Thence along last said line North 37 29' 02" East 0.46 feet to a point on the aforesaid direct extension southeasterly of the line between Lots 35 and 36; Thence along said direct exten- sion North. 47° 43' 14" West 107.34 feet to the TRUE POINT OF BE- GINNING; and Whereas, the aforesaid parcel of land is no longer required by the City for municipal purposes and the best interests of the City will be served by disposing of same; Now; Therefore, Be It Ordained By The Council of the City of Alameda: Section 1. That the City's right, title and interest in and to the here - inbefore described parcel of land be sold and conveyed to the highest and best bidder therefor, with the reser- vation to the City of the right to re- ject any and all bids. Section 2. That the instrument of conveyance hereinafter referred to shall reserve unto the City, its suc- cessors, assigns and permittees, a per- petual easement and right to con- struct, reconstruct, repair and main - am, or permit to be constructed, re- constructed, repaired and - maintained, electric, telephone and telegraph lines for the transmission and distribution of electricity, and for telephone and telegraph service, including poles and pole lines, underground conduits, man - holes, wires, cables; guy wires and other appliances and appurtenances required or useful for such purposes, together with the right of ingress and egress for such purposes, over, under, along or across the rear five (5) feet of each lot, parcel or piece into which said real property may be divided or subdivided. Section 3. That the aforesaid prop- erty shall be sold in the manner, on such terms and subject to such con- ditions and restrictions as shall be determined by the City. Section 4.
