Ordinance 1143ORDINANCE NO. 1143 New Series AUTHORIZING EXECUTION OF DEED OF GRANT CONVEYING TO ALA- MEDA UNIFIED SCHOOL DISTRICT OF ALAMEDA COUNTY, STATE OF CALIFORNIA, 'A PUBLIC CORPORA- TION, CERTAIN REAL PROPERTY IN THE CITY OF ALAMEDA (WASH - INGTON SCHOOL; SITE). WHEREAS, Alameda' Unified School District has for many years past occu- pied and used and is now occupying and using the hereinafter described City owned property for public school purposes by and with the permission and consent of the City and Alameda; and WHEREAS, said Alameda Unified School District has conducted negotia- tions with 'the Federal' Government for the reservation of certain moneys ($561,744:00) to be used by said Dis- trict for the construction of a new school building on the said property, to replace Washington School present- ly located thereon; and WHEREAS, transfer of said moneys by the Federal Government to the Dis- trict is conditioned upon the District furnishing to the Federal Government a certificate of title evidencing the vesting of a fee: simple 'estate in said property in said District; and WHEREAS, the Council of the City of Alameda, having duly considered the matter, believes that the -best' in- terests of the City of Alameda will be served by a, transfer and conveyance of the City's title to said property to the Alameda Unified School District, subject to a provision for reversion of the title to said property to the 'City of Alameda upon the cessation and termination of the use and occupancy of said property for public school pur- p oses; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA Section 1. That the Mayor of the City of 'Alameda be, and he is hereby authorized and directed to execute, and the City Clerk to attest, as the act and deed of the City of Alameda, a good and sufficient deed of grant, granting and conveying to Alameda Unified School ' District of Alameda County, State of California, a public corporation, for the consideration of Ten ($10.00) Dollars, all that certain real property situate in the City of Alameda, County of Alameda, State of California, described as follows: COMMENCING at the point of intersection of the southern lute of Santa Clara Avenue with c the eastern line of Eighth (formerly Prospect) Street, as said avenue and street existed on February 8, ; 1909;' running thence easterly along said line of Santa Clara Avenue 320 feet; thence at right angles south- erly 270 -feet more or less to the northern line of Taylor Avenue; thence westerly along said line of Taylor Avenue 320 feet to the east- ern line of Eighth (formerly'Pros- pect) Street; and thence northerly along said last named line 270 feet more or less to the point of com- mencement. BEING portion of the Aughin- baugh 223 acre tract (so called). Section 2. That said deed of grant shall contain, among other things, the provision that, in the event the use and occupancy of said property for public school purposes shall cease and terminate, title in and to the herein described property shall thereupon and forthwith revert to and vest in the City of Alameda. Section 3. This ordinance is hereby declared to be a measure of great emergency and shall make effect im- mediately. The following is a statement of the emergency: The Alameda Uni- fied School District' has represented that a tight time schedule is involved in obtaining transfer from the Federal Government of the moneys hereinbe- fore mentioned = and that, unless this ordinance is made effective:immediate- ly, the negotiations for such transfer may be jeopardized.
