Ordinance 1157ORDINANCE. NO. 1157 New Series AN ORDINANCE AUTHORIZING AC- QUISITION OF CERTAIN REAL PROPERTY FOR PUBLIC PUR- POSES (NEW SUBSTATION) WHEREAS, public interest and ne- cessity require that the real property hereinafter described be acquired by the City of Alameda for and on behalf of said City's Bureau. of Electricity for the purpose of constructing thereon an electrical substation; and WHEREAS, J. J. Manning, Jr. is the owner of said real . property and is willing to sell same to the City of Alameda for the sum of Seventeen Thousand ($17,000.00) Dollars; BE IT ORDAINED BY THE COUN- CIL OF THE CITY OF ALAMEDA : Section. 1. That the City of Alameda purchase from J. J. Manning, Jr., for the sum of Seventeen Thousand ($17,000.00) Dollars, that certain real property situated in the City of Ala- meda, County of Alameda, State of California, particularly described as follows: LOTS 2, 3 and the rear 15 feet of LOT 1, Block "F." Waterside Terrace, shown on the Map en- titled, "Waterside Terrace, Ala- meda, Cal:," filed August 30, 1912, in Boob 27 of Maps, page 12, in the office of the County Recorder of Alameda County, on the following terms and conditions: (a) That good and merchantable title in fee sample in said real prop- erty be conveyed to the City . of Ala- meda, free .and clear of all objections, liens and encumbrances. (b) That the title to said real prop - erty be evidenced by a policy of : title insurance issued by Oakland Title In- surance . Company, a corporation, in- suring title in the City, as provided in the preceding subdivision, said title insurance to be at the expense of the City of Alameda. (c) That upon deposit with said title company for delivery to the City of a good and sufficient deed of grant con - veying said property to the City and conditioned upon the issuance of a title insurance policy, as aforesaid to be approved by the City. Attorney, a warrant: of the Public Utilities Board be drawn for $17,000.00, payable to the order of and delivered to said Oak - land 'Title Insurance Company, a cor- poration, as escrow holder, for the purpose of effecting the consumma- tion of said purchase, Section 2. The sum of $17,200.00 is hereby appropriated from the Bureau of Electricity fund to pay the purchase price of .sand real property, cost of title insurance, and other expenses. Section 3. This ordinance is hereby declared to be a measure of great emergency and shall be in effect im- mediately. The following is a state- ment of the facts showing the urgency: This property is being acquired under an option which will expire August 27, 1455. If this ordinance were to take the course of a non-emergency ordinance it would become effective after expiration of the option to pur- chase and the property might not then be available. R, P.
