Ordinance 1162Ordinance No. 1162 New Series A N ORDINANCE AUTHORIZING CONVEYANCE OF CERTAIN TIDE AND SUBMERGED LANDS TO THE CITY OF OAKLAND, A MUNICIPAL CORPORATION, AND APPROVING THE FORM OF DEED. WHEREAS, on March 21, 1958, the City of Alameda and the Port of Oak- land arrived at a settlement of cer- tain condemnation proceedings insti- tuted by the Port of Oakland against the City of Alameda and others in the Alameda County Superior Court, the terms of said agreement of settlement providing, among other things, ,that, in the event legislation was enacted en- abling the City of Alameda to do so, the City would convey to the City of Oakland in fee simple certain de- scribed tide and submerged lands in- cluded within the tidelands grant to the City made by Chapter 348, Stat- utes of 1913, as amended, and WHEREAS, by Senate Bill No. 580, enacted by the Legislature of the State of California in its 1955 session, the City of Alameda is empowered to grant to the City of Oakland any of its salt marsh, tide or submerged lands, in trust for the same uses and pur- poses and upon the same conditions that said lands were acquired by the City of Alameda from the State of California, and WHEREAS, a form of deed convey- ing the aforementioned premises to the City of Oakland has been prepared and submitted to this Council at its regular meeting held Sept. 13, 1955 and ordered filed in the office of the City Clerk and marked Filed Sept. 13, 1955," and WHEREAS, it is in the public in- terest that said lands be so conveyed. NOW THEREFORE BE IT OR- DAINED BY THE COUNCM OF THE CITY OF AT:A.M.F as follows: Section 1. That the form of Deed referred to in the preamble hereof and the terms and conditions thereof be and the same are hereby approved. Section 2. That the lands described in said form of Deed be conveyed in fee simple to the City of Oakland, a municipal corporation, in trust for the same uses and purposes and upon the same conditions that said lands were acquired by the City of Alameda from the State of California. Section 3. That the Mayor of the City of Alameda be and he is hereby authorized and directed to execute, and the City Clerk to attest, as the act and deed of the City of Alameda, a grant deed substantially in the form of the aforesaid form of Deed. Section 4. This Ordinance is hereby declared to be a measure of great emergency and shall be in effect im- mediately. The following is a state- ment of the facts showing the ur- gency: The Port of Oakland has al- ready received bids for the immedi- ate dredging of the lands to be con- veyed and wishes to proceed with the work without the delay attendant upon this Ordinance taking a non - emergency course.
