Ordinance 1172Alameda Clity Ordinances Ordinance No. 1172 New Series AN ORDINANCE AMENDING THE ALAMEDA MUNICIPAL CODE BY REPEALING SECTION 9-143 AND ADDING SECTIONS 9_149, 9-1410, 9-1411, 9-1412, AND AMENDING SEC- TION 9-146, RELATING TO DOGS BE IT ORDAINED BY THE COUN- CIL OF THE CITY OF ALAMEDA as follows: Section 1. That Section 9-143 of the Alameda Municipal Code be, and the same is hereby repealed. Section 2. That Section 9-146 of the Alameda Municipal Code be, and the same is hereby amended to read as follows: Sec. 9-146. Seizure and Disposi- tion of Untagged and Unleashed Dogs — Redemption. Every dog found or being in any public street of said City and not being held or led by cord, chain, or other thing, or confined in any vehicle, shall be taken by the Poundmaster to, and impounded in the Public Pound, where it may be redeemed by the owner or persons theretofore entitled to the possession of it within five (5) days thereafter, on payment to the Poundmaster of Five ($5,00) Dollars, and upon se- curing a vaccination as required under this Code. If not so re- deemed such dog shall be killed and buried by the Poundmaster, provided, that the Poundmaster is authorized to keep valuable dogs and sell them, and his receipt for the sale thereof, endorsed by the City Clerk, shall be a valid title to the purchaser. If a license tax has not been paid for the then current year for any impounded dog, the party redeeming must, before re- demption, pay such license tax, provided, that in case of loss of tag, a duplicate of the same must be obtained as provided in this Code, and on presentation of said duplicate tag the owner of said impounded dog shall be entitled to the possession of the same on pay- ment of fifty cents (50c) in addi- tion to the :redemption fee and vaccination requirement above set forth, Whenever a dog is redeemed the party redeeming must give to the Poundmaster duplicate receipts acknowledging the redemption and a certificate showing a current vaccination. Section 3, That the Alameda Munici- pal Code is hereby amended by adding Section 9-149, 9-1410, 9-1411 and 9-1412 thereto, which sections shall read as follows: ­". See, 9-149. Vaccination Required. It shall be unlawful for any person owning, harboring, or having the care, custody or possession of any dog to keep or maintain such dog in any place in the City of Ala- meda unless such dog has been vaccinated as required by this Code, excepting dogs confined within the private property of the owner or person having control of said dog See, 9-i4ft). No Licensing Without Vaccination. The license collector shall not license any dog until it has been vaccinated with canine antirabies vaccine, by injection or other method approved by the submits a Certificate of Vaccina- tion from a licensed veterinarian confirming the approved vaccina- tion of said dog valid for a period extending at least through the cur- rent licensing period. The effective duration of immunity elicited in dogs vaccinated with canine anti- rabies vaccines, modified live-virus chick - embryo origin or with brain- tissue killed-virus phenolized or other, recognized for the purpose of this ordinance, shall be specified by the Health Officer but shall not in any event exceed those periods recommended by the California Conference of Local Health Offi- cers. The license collector may license any dog not so vaccinated, pro- vided, that said dog is at all times confined within the private prop- erty of the owner, and further provided, that the owner of said dog shall, at the time of applica- tion for a dog tag, sign a written statement provided by the license collector stating that said dog is at all times kept confined within the private property of the owner. The signed statement shall be known as a Certificate of Exemption. See. 9-1411. Vaccination—Certifi- cale. Said vaccination shall be per- formed by a duly qualified and licensed veterinarian. The person vaccinating said dog shall issue to the owner or person in possession of said dog a certificate of vaccin- ation which shall include a state- ment as to the type of canine antirabies vaccine used in vaccin- ating said dog. See. 9-1412. Leashing. It shall be unlawful for any person having an interest in, owning, harboring or having in charge, care or control, custody or possession of any dog to cause or permit such dog to be in, on, or upon any public street, alley, or other public place, unless such dog is kept securely fastened by a rope, chain or leash not over five feet (5') in length and under the supervision of a responsible person, or confined within the pri- vate property of the owner or per- son having control of said dog. It shall be the duty of such person to curb said dog. Section 4. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage, R. P.
