Ordinance 1176Alameda Clity Ordinances Ordinance No. 1176 New Series AN ORDINANCE AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY FOR PUBLIC OFF- STREET PARKING PURPOSES WHEREAS, public interest and ne- cessity require that the real prop- erty hereinafter described be acquired by the City of Alameda for use by said City for public off-street motor vehicle parking places, including prop- erty necessary or convenient for in- gress thereto or egress therefrom; and WHEREAS, H. R. NORTON and DOROTHY NORTON, his wife, are the owners of the real property here- inafter described and are willing to sell the same to the City of Alameda for the sum of $1,500.00; BE IT ORDAINED BY THE COUN- CIL OF THE CITY OF ALAMEDA: Section 1. That the City of Alameda purchase from H. R. NORTON and DOROTHY NORTON, his wife, for the sum of $1,500.00, that certain real property situated in the City of Ala- meda, County of Alameda, State of California, more particularly described as follows: BEGINNING at a point on the northeastern line of Post Office Court, distant thereon 71 feet northwesterly from the northwest- erly line of Park Avenue; running thence northwesterly along said line of Post Office Court, 21 feet; thence northeasterly parallel with said northwesterly line of Park Avenue 22.54 feet, more or less, to a point in the southwesterly boundary line of that certain piece or parcel of land conveyed by Mar- tin Brennan, et. ux., to H. H. Roth, et, ux., by deed dated June 16, 1920, recorded in Book 2905 of Deeds, page 407, Alameda Coun- ty Records; thence southeasterly along the southwesterly boundary line of the land so conveyed, 21 feet to a point; thence southwest- erly parallel with said northwest- erly line of Park Avenue 22.54 feet to the point of beginning, on the following terms and condi- tions: (a) That good and merchantable title in fee simple in said real prop- erty be conveyed to the City of Ala- meda, free and clear of all objections, liens and encumbrances; city and County taxes to be prorated a s of date of closing of this sale. (b) That the title to said real prop- erty be evidenced by a policy of title insurance issued by Oakland Title Insurance Company, a corporation, in- suring title in the City, as provided in the preceding subdivision, said title insurance to be at the expense of the City of Alameda. (c) That upon deposit with said title company for delivery to the City of a good and sufficient deed of grant conveying said property to the City and conditioned upon the issu- ance of a title insurance policy, as aforesaid, to be approved by the City Attorney, a warrant of the City be drawn for $1,500.00, payable to the order of and delivered to said Oakland Title Insurance Company, a corporation, as escrow holder, for the purpose of effecting the consummation of said purchase. Section 2. The sum of $1,535.00 is here- by appropriated from the Off-Street Parking Project Construction Fund to pay the purchase price of said real property, cost of title insurance policy, and other expenses. Section 3. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. R. P.
