Ordinance 1180ORDINANCE NO. 1180 New Series AN ORDINANCE AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY FOR PUBLIC OFF- STREET PARKING PURPOSES WHEREAS, public interest and ne- cessity require that the real prop- erty hereinafter described be acquired by the City of Alameda for use by said City for public off-street motor veil icle parking places, including prop- erty necessary or convenient for in- gress thereto or egress therefrom; and WHEREAS, American Securities Company, a corporation s the owner of the real property corporation, de- scribed and is willing to sell the same to the City of Alameda for the sum of $11,500.00; BE IT ORDAINED BY THE COUN- CIL OF THE CITY OF ALAMEDA: Section 1. That the City of Alameda purchase from American Securities Company, a corporation, for the sum of $11,500.00, that certain real prop- erty situated in the City of Alameda, County of Alameda, State of Cali- fornia, more particularly described as follows: COMMENCING at a point on the southwestern line of Santa Clara Avenue, distant thereon south- easterly 100 feet from the south- eastern line of Park Street and running thence at right angles to said line of Santa Clara Avenue southwesterly 65.19 feet to the actual point of beginning; thence continuing along said line south- westerly 55 feet; thence at right angles southeasterly 40 feet; thence at right angles southwesterly 22 feet; thence at right angles south- easterly 35.58 feet; thence at right angles northeasterly 77 feet to a line drawn parallel with the southwestern line of Santa Clara Avenue and distant at right angles 65.19 feet southwesterly therefrom; thence along said parallel line northwesterly 75.68 feet to the actual point of beginning, on the following terms and conditions: (a) That good and merchantable title in fee simple in said real property be conveyed to the City of Alameda, free and clear of all objections, liens and encumbrances. (b) That the title to said real prop- erty be evidenced by a policy of title insurance issued by Oakland Title In- surance Company, a corporation, in- suring title in the City, as provided in the preceding subdivision, said title insurance to be at the expense of the City of Alameda, (c) That upon deposit with said title company for delivery to the City of a good and sufficient deed of grant conveying said property to the City and conditioned upon the issu- ance of a title insurance policy, as aforesaid, to be approved by the City Attorney, a warrant of the City be drawn for $11,500.00, payable to the order of and delivered to said Oak- land Title Insurance Company, a cor- poration, as escrow holder, for the purpose of effecting the consumma- tion of said purchase. Section 2. The sum of $11,600.00 is hereby appropriated from the Off - Street Parking Project Construction Fund to pay the purchase price of said real property, cost of title in- surance policy, and other expenses. Section 3. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. R. P.
