Ordinance 1227Ordinance No. 1227 "Alameda t New Series ORDINANCE NO. 12,27 New 3Series AN ORDINANCE AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY < AT THE NORTHEAST <CORNER rOF BUENA VISTA AVENUE AND SHERMAN STREET WHEREAS, public interest and ne- cessity require that the real property hereinafter described be acquired by the City of Alameda; and WHEREAS, the owner of said real property, Lorraine Berta, has .agreed to grant said real property to the City of Alameda upon the terms and conditions set out hereinafter; NOW THEREFORE, BE IT -OR- DAINED BY THE COUNCIL OF THE CITY OF ALAMEDA: Section 1: That the City of Alameda purchase from Lorraine Berto for the sum of $4,300.00 that certain real property situated in the City of Ala- meda; County of Alameda, State of California, and more particularly de- scribed as follows: BEGINNING at the point of in- tersection of , the - northern line of Buena Vista Avenue with -the- east - ern line of Sherman Street, for - merly St. George Street; running thence easterly along the said line of Buena Vista Avenue 39 feet; thence at right angles northerly 95 feet; thence at right angles west- erly 39 feet to the said line of Sherman Street; thence southerly along the said line of Sherman Street 95 feet to the said line of Buena Vista Avenue and the point of beginning; BEING a portion of Lots 1 and 2, in Block "B," as the said lots and block are shown on the "Map, of 144 Lots in Page Tract, Alameda County, etc., filed February ,25, 1874, in Book 6 of Maps, at Page 7, in the office of the County Re- corder of Alameda County, on the following terms and condi- tions: a. That good - and merchantable title in fee simple in said real prop - erty be conveyed to the City of Ala- meda, free and clear of all objections, liens, and encumbrances City and County taxes to be prorated as of the date of closing; of the transaction. b That the title of said real property be evidenced by a,policy of title in- surance issued by Oakland Title In- surance Company, a corporation, in- suring title in the City of Alameda', as provided in the preceding subdi- vision, said title insurance to be at the expense of the City of Alameda. c. That upon' deposit with said title company for delivery to the City of Alameda of a good and < sufficient deed of grant conveying said prop- erty to said city and conditioned upon the issuance of a title insurance policy, as aforesaid to be approved by the City Attorney, a warrant of the City of Alameda be drawn for $4,300.00, payable to the order of and delivered to said Oakland Title Insur- ance Company, a corporation, as es- crow holder, for the purpose of ef- fecting the consummation of said purchase. Section 2. The sum of $4,400.00 is hereby appropriated from the Special Gas -Tax Street Improvement Fund (Account 222), , to pay the purchase price of said real, property, cost of title insurance; and other expenses. Section 3. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date' of its final passage. RAYMOND P.
