Ordinance 1237ORDINANCE NO. 1237 An ordinance authorizing the exchange of real property by and between the city of alameda and the alameda unified school district (everett school mastick school longfellow school burbank school) Alameda Clity Or August 19, 1884 in Book 4 of Maps at Page 23, in the Alameda County Recorder's Office, and further: de- scribed to -wit: Part A BEGINNING at the point of intersec- tion; of the easterly line of 'Fifth Street, 60 feet in width; with the southerly , line of ' Pacific Avenue, 60 feet in width, as said street and avenue now exist; THENCE along the said southerly line of Pacific Avenue South 88 25' East 199.17 feet; THENCE parallel with the said east- erly line of Fifth Street South 1° 35' West 56.00 feet; ; THENCE at right angles to the last said line North 88° 25' West 65.67 feet THENCE again parallel with the east- erly line of Fifth Street South 1 ° 35' West 94.00 feet; THENCE parallel with the said southerly <' line of Pacific Avenue North 88 25' West 133.50 feet to a point in the said easterly line of Fifth' Street; THENCE along the last said line North 1 35' East 150.00 feet to the BEGINNING. Part B BEGINNING at a point in the south- erly line of Pacific; Avenue, 60 feet in width, said point being ; North 88 25' West along said 'southerly line 390.00 feet from its intersection with the - westerly line of 'Sixth Street (formerly; Third Avenue), 60 feet: in - width, as said street and avenue now exist; THENCE parallel with the said west- erly line of Sixth Street South 1° 35' West 150.00 feet; THENCE at right angles to the last said dine North 88 25' West 10.00 feet; THENCE again parallel with the said westerly line of Sixth Street South i° r35' West '150.00 'feet to a' -point in the northerly line of Lincoln Avenue '(formerly Railroad Avenue) as said avenue is also shown on the said map; THENCE along the last said line North 88 25'- West 205.83 feet; THENCE again parallel with the said westerly line' of Sixth Street North 1 35' East 206.00 feet; THENCE at right angles to the last said line South 88 25' East - 81.50 feet; again parallel' with the said westerly line of Sixth Street North 1 35' East 94.00 feet to a point in the said southerly line of Pacific Avenue; THENCE along the last said line South 88 25' East 134.33 feet to the BEGINNING; dienances Ordinance No. 1237 New Series subject to the following terms and conditions: (a) That good and merchantable title in fee - simple: in the said =real property to be conveyed to the City of Alameda be conveyed free and clear- of all objections, liens and en- cumbrances. (b) That the title to said real prop- erty to be conveyed to the City of Alameda be evidenced, by a policy of title insurance issued by a duly licensed title insurance company in- suring the title in the City of Ala- meda pursuant to Section I (a) above. (c) That each party hereto shall pay; his own respective closing costs, including' title insurance and escrow fees; if any Section 2. That there is hereby appropriated from the Contingent Fund, Account 199, the amount of $250.00, to pay for the expenses set out in Section -1 (c) above. Section 3. That the Mayor of the City of Alameda is hereby authorized to execute the deed of the City of Alameda, for and on behalf of the City of Alameda, to the real property to be conveyed by the City, of Ala - meda, as described herein and the City; Clerk is directed to attest to the same. Section 4:' This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. WILLIAM M. McCALL, Presiding Officer of the Council.
