Ordinance 1267 Ordinance No. 1267 AN ORDINANCE - AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY FOR STREET, HIGHWAY . AND GENERAL MU- NICIPAL PURPOSES (WIDENING OF WILLOW STREET— WACHTEL) WHEREAS, public interest and necessity require that the real prop- erty hereinafter described be ac- quired by the City of Alameda for street, highway and general munici- pal purposes; and WHEREAS, Michael Wachtel and Margot Wachtel, his wife, are the owners of the real property herein- after described and are willing to sell the same to the City of Ala- meda for the sum of ONE THOU- SAND, TWO HUNDRED SIXTY ($1,260.00) DOLLARS, in addition to other consideration; NOW THEREFORE, BE IT OR- DAINED BY THE COUNCIL OF THE CITY OF ALAMEDA: Section 1. That the City of Ala- meda purchase from Michael Wachtel and Margot Wachtel, his wife, for the sum of $1,260.00 in addition to other consideration, as described in Sec- tion 2 below, that certain real prop- erty situated in the City of Alameda, County of Alameda, State of Cali- fornia, and more particularly des- cribed as follows: A portion of the parcel of land conveyed to Michael Wacb- tel and Margo Wachtel, his wife, by deed recorded February 3, 1948, under Recorder's Serial No. AC 9696 in Book 5398 of Official Records of Alameda County, at page 371, and more particularly described as follows: BEGINNING at the intersec- tion of the southwestern line of Clinton Avenue and the center line of Willow Street and run - ning thence along said center line South 29 47' 23" West 75.02 feet; thence South 60° 12' 37" East 27.00 feet to a line drawn parallel to said center line and distant 27.00 feet therefrom measured at right angles there- to; thence along said parallel line North 29° 47' 23" East 75.02 feet to the said line of - Clinton Avenue; thence along the last said line North 60 I1' 30" West 27.00 feet to the point of be- ginning. Excepting therefrom that portion thereof lying within the lines of Willow Street as the same now exists 40 feet wide. On the following terms and con- ditions: (a) That good and merchant - able title in fee simple in said real property be conveyed to the City of Alameda, free and clear of all objections, liens, and encumbrances; City and County taxes to be prorated as of the date of closing of this sale. (b) That the title of said real property be evidenced by a policy of title insurance issued dionances C)rctlnanc e Nu. 1267 New Series by California Pacific Title In- surance Company, insuring title in the City, as provided in the preceding subdivision. (c) That upon deposit with said title company for delivery to the City of a good and sufficient deed of grant conveying said property to said City and con - ditioned upon the issuance of a title insurance policy, as afore- r said, to be approved by the City';' Attorney, a warrant of the City; be drawn for $1,360.00, ; payable to the order of and delivered to J California Pacific Title Insur- ance Company, as escrow holder, for the purpose of effecting the consummation of said purchase and payment of title insurance. Section 2. That the additional con- sideration referred to in Section I above is as follows: City agrees to perform the following work and make the following installations` on the remaining property of Michael Wachtel and Margot Wachtel, his wife, at its own cost and expense: as set out below: 1. Cut driveways at conform line and reconstruct. 2. Cut retaining walls at driveways to back of sidewalk. 3. Remove sidewalk at build- ing entrance and reconstruct ' to meet steps. 4. At garage: (a) Remove Portland concrete cement floor and reconstruct at 'a 10 -inch dower elevation; (b) - Extend footings to contain new floor (c) Alter doorway: , reframe, -re- stucco and paint, reset door?: and door hardware to new floor level Section 3. The sum of $1,360.00 is hereby appropriated from the Special Gas Tax Street Improvement Fund (Account 222) to pay the purchase price of said real property and cost of title insurance: policy. - Section 4. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final pas- sage. WILLIAM M.
