Ordinance 1296ORDINANCE NO. 1296 An ordinance authorizing the acquisition of certain real property and authorizing the treansfer of certain city-owned real property in partial consiferation of such acquisition tilden way standard oil co property THENCE continuing along, said southerly line of Tilden Way and tangent to the last said point, '! South 76° 29' 26" West 243.35 feet to the TRUE POINT OF BEGIN -' NING; and that, in consideration therefor, the City of Alameda shall pay unto the said Standard Oil Company of California the sum of THIRTEEN THOUSAND, SIXTY -FOUR and NO1- 100 ($13,064.00) DOLLARS, and shall transfer unto the said Standard Oil Company of California all that cer- tain real property situate in the City of Alameda, County of Alameda, State of California, and more par- ticularly described as follows: COMMENCING at the intersec- tion of the southeasterly line of Pearl Street and the northwest - erly line of Fernside Boulevard as said lines, street and boule- vard are described in that deed to the City of Alameda and re- corded February 27, 1952 in Book 6666 of Official Records, at page 523, in the Alameda County Re- corder's office, and as also shown on Drawing 3939, Case 51, Sheet 5 and Sheet 9, City Engineer's Files, City of Alameda, California; said intersection has the coordinates of y 466,154.49 feet and x - 1,499, - 446.29 feet based on the Cali - fornia Coordinate System, Zone IH; as are all bearings, distances and coordinates in this descrip- tion; THENCE along said northeast - erly line of Fernside Boulevard South 55° 36' 00" East 140.36 feet to the intersection with the northwesterly line of that parcel of land described in deed to the Standard Oil Company of Cali - fornia and recorded March 15, 1929 in Book 2084 of Official Records, at page 213, in the Ala - ineda County Recorder's office, THENCE along said northwest - erly line of the described parcel of land, being parallel with the aforesaid southeasterly line of Pearl Street, North 34° 27' 25" East 140.00 feet to the TRUE POINT OF BEGINNING, having coordinates of y 466,190.62 feet and x 1,499,641.33 feet; THENCE North 69° 58' 57" West 122.14 feet to the southerly line of Tilden Way, 70 feet in width, as said way is shown on the aforesaid drawing, THENCE along said southerly line of Tilden Way North 76° 29' 226 East 176.65 feet to the afore- said northwesterly line of that parcel of land described in the deed to the Standard Oil Com- pany; THENCE along said northwest - erly line South 34 27' 25" West 100.75 feet to the TRUE POINT OF BEGINNING. The acquisition and transfer set out above shall be subject to the follow- ing terms and conditions: (a) That good and merchantable title in fee simple in the real prop- erty to be transferred to the City Ordiii:mee No. 1296! of Alameda ' be conveyed free and clear of all objections, liens and en- cumbrances; City and County taxes to be prorated as of the date of the consummation of this itransac- tion* (b) That the title to the real prop- erty to be transferred to the City of Alameda be evidenced by a policy of title insurance` issued by a duly licensed title insurance company, in- suring title in the City of Alameda, as provided in the preceding sub- division. (e) That a warrant of the City of Alameda be drawn for the sum of $1.3,064.00, payable to the order of and delivered to a duly licensed title insurance company, as escrow hold- er for the purpose of effecting the consummation of this transaction. Section 2. That the sum of $13,064.00 is hereby appropriated from the Special Gas Tax Improvement Fund (Account 222) to discharge the obli- gation of the City of Alameda which arises from this transaction. Section 3. That a sum sufficient to pay the cost of title "insurance, escrow fees; and other expenses at -: tendant to this transaction, and as approved by the City Manager, is hereby appropriated from the Special Gas Tax .Improvement Fund (Ac- count 222). Each party hereto shall pay their own respective title insur- ance costs. Section 4. That the Mayor of the City of Alameda is hereby author- ized to execute, for and on behalf of the City of Alameda; a good and sufficient grant deed conveying to the Standard Oil Company of Cali- fornia the real property described herein, which is to be transferred to such grantee. The City; Clerk is hereby directed to attest to same. Section 5. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final pas- sage, WILLIAM M. McCALL, Presiding Officer of the Council.
