Ordinance 1335Alameda a New Series l �� O r d inances Ordinance No. 1335 Ordinance New Series AN O R D I N A N C E AMENDING CHAPTER 5 OF TITLE XII OF THE ALAMEDA AUNICIPAL CODE BY AMENDING ARTICLE 2 IN ITS ENTIRETY AND SECTION 12 -573 OF ARTICLE 7; BY REPEALING ARTICLES 3, 5 AND 8 IN THEIR ENTIRETY AND SECTION 12 -572 OF ARTICLE 7, ALI. RELATING TO RESTAURANTS, FOOD PRO - i:lLtt'TS ANll BEVERAGES; BY HE- PF_ALING CHAPTER 6 OF TITLE XII IN ITS ENTIRETY; AND ADOPTING BY REFERENCE OR- DINANCE 285 N. S. OF THE COUN- TY OF ALAMEDA, ALL RELAT- ING TO MILK PRODUCTION, DISTRIBUTION AND SALE. BE IT ORDAINED BY THE COUN- CIL OF' THE CITY OF ALAMEDA: Section 1. That Article 2 of Chap- ter 5, Title XII, of the Alameda Municipal Code be amended to read as follows: Article 2. Restaurants Sec. 12 -521. Operation of Restau- rant, Etc., Unlawful Without Permit and Compliance With Regulations. It shall be unlawful for any person, firm or corporation owning, control - me, leasing, acting as agent for, conducting, operating or managing any restaurant, cafe, lunch counter, cafeteria, soda fountain, ice cream parlor, soft drink stand, fruit stand, grocery, or other place in the City of Alameda, where food is prepared for sale, sold, distributed or displayed for sale, to conduct or operate, or to cause or permit to be conducted or operated, such restaurant, cafe, lunch counter, cafeteria, soda foun- tain, ice cream parlor, soft drink stand, fruit stand, grocery, or other place where food is prepared for sale, sold, distributed, or displayed for sale, or for any such person to sell, or offer for sale, or to cause to permit to be sold or offered for sale, or to give away or to cause or permit to be given away any food or drink therein or therefrom without first applying for and receiving from the County Health Officer a permit therefor, in the manner hereinafter provided. Sec. 12 -522. Application. Every ap- plicant for such permit shall file with the County Health Officer writ- ten application which shall state the name and address of the applicant, a description of the property by street and number, wherein or where- on it is proposed to conduct such restaurant, cafe, lunch counter, cafe - teria, soda fountain, ice cream par- lor, soft drink stand, grocery or other food distributing place, also the character of business which is proposed to be conducted, and such other information as the County Health Officer may require. Sec. -12 -523. Investigation and Is- suance of Permit — Revocation or Sus- pension Grounds. Upon receipt of such application, it shall be the duty of the County Health Officer to in- vestigate the matters set forth in such application and the sanitary con- ditions in and about the place where- in or whereon it is proposed to con- duct the business mentioned in the application, and if it shall appear 0 said County Health Officer that the statements contained in the ap- plication are true, and that the ex- isting sanitary conditions in the said place mentioned in said application comply with the provisions of the ordinances and State laws in force at the time such application is con- sidered, and conform to the rules and regulations of the County Health Department, a permit shall there- upon be granted; provided, however, that such permit shall be granted only on the express condition that it shall be subject to revocation or suspension by said County Health Officer upon a showing satisfactory to him of a violation by the holder of such permit, his employee, servant or agent, or any other person acting with his consent or under his au- thority, of any provision of any or- dinance of the City of Alameda, or any law of the State of California, or any rule of the County Health Department regulating places of the character set forth in Section 12 -521. Section 2. That Article 3 (Bakeries — Bread) of Chapter 5. Title XII, of the Alameda Municipal Code, com- prised of Sections 12 -531 through 12- 537, is hereby repealed. Section 3, That Article 5, (Fruits and Fruit Stands) of Chapter 5, Title XII, of the Alameda Municipal Code, consisting of Section 12 -551, is hereby repealed. Section C That Section 12 -572 of Article 7 (Hams and Bacon to be Stamped), Chapter 5, Title XII, of the Alameda Municipal Code, is here- by repealed. Section 5. That Section 12 -573 of Article 7, Chapter 5, Title XII, of the Alameda Municipal Code be amended to read as follows: Sec. 12 -573. Fresh Meat Coolers. All meat markets must be equipped with a walk -in cold storage room of ade- quate dimensions. The interior of such cold storage room shall be of light color and have a glossy finish. Such equipment shall maintain a temperature below 45 deg. F. with sufficient circulation, and shall be installed in accordance with the pro- visions of the Plumbing Code of the City of Alameda. Section 6. That Article 8 (Soft Drink Establishments) of Chapter 5, Title XII, of the Alameda Municipal Alamed Cl On Code, comprised of Sections 12 -581 through 12 -583, is hereby repealed. Section 7 That all of Chapter 6, Title XII;;of the Alameda Municipal Code, relating to milk production, distribution and sale, is hereby re- pealed. Section 8. That Ordinance 285 N.S., adopted by the Board of Supervisors of the County of Alameda on June 27, 1957 and amending Title 3 of the Alameda County Ordinance Code, relating to the regulation of the production, processing, sales and dis- tribution of market milk, cream, milk products and imitation milk products, and consisting of Articles 1 through 9, be, and the same is hereby adopted as the Milk Produc- tion, Distribution and Sale Regula- tions of the City of Alameda; that three (3) copies of said Ordinance 285 N.S. are on file in the office of the City Clerk of the City of Alameda, being marked "Filed June 8. 1960." Section 9. This ordinance shall be in full force and effect from and after the expiration of thirty (30) New Series 1 Ordinance No. 1335 days from the date of its final passage. WILLIAM M.
