Ordinance 1358ORDINANCE NO. 1368 New Series AN ORDINANCE AMENDING CER- TAIN PORTIONS OF THE ALA- MEDA MUNICIPAL CODE RELAT- ING TO SUBDIVISIONS (SEC- TIONS 11 -315 AND II -319). BE IT ORDAINED BY THE COUN- CIL OF THE CITY OF ALAMEDA : Section 1. Section 11- 315(c) and (d) of the Alameda Municipal Code are hereby amended to read as follows: Sec. 11 315(c). "Subdivider" shall mean any individual, firm, asso- ciation, syndicate, copartnership, corporation, trust or any other legal entity commencing proceed- ings under this ordinance to ef- fect a subdivision or division of land hereunder for himself or for another. Sec. 11- 315(d). "Subdivision" re- fers to any real property, im- proved or unimproved, or portion thereof, shown on the latest adopted county tax roll as a unit or contiguous units, which is di- vided for the purpose of sale or lease, whether immediate or fu- ture, by any subdivider into two (2) or more parcels; provided, that this chapter shall not apply to the leasing of apartments, e-f- fices, stores, or similar space within an apartment building, industrial building, or commer- cial building, nor shall the chap- ter apply to mineral, oil or eas leases. Section 2. A new Section 11- 315(1) is hereby added to the Alameda Municipal Code, which shall read as follows Sec. 11- 315(1). "Division of land" shall mean a subdivision of land resulting in the creation of four (4) or less parcels. Section 3. A new Section 11 -319.1 is hereby added to the Alameda Municipal Code, which shall read as .follows: See. 11- 319.1. The Tentative Map of the division of land into four (4) or less parcels shall show the data required for subdivisions, except that in cases where no street construction, improvement, widening or dedications or reser- vations for public purposes are required, the Planning Board shall accept a Property Division Map showing the lot design and dimensions and information re- quired by the City Engineer in lieu of a Tentative Map, and the City Council shall permit the re- cording of an approved Property Division Map in lieu of a Final Map in such cases: provided, however, in the event street con- struction, improving or widen - ing, dedication, or reservations for public purposes are required, the Planning Board may give linances Ordinance art. 1368' New Series conditional approval to a Proper- ty Division Map presented under this section, said approval being conditioned by and contingent upon the construction of any street, or the improving or widen - ing thereof as required by the Planning Board, and the requis- ite offering for dedication or reservation of the same for pub- lic purposes; or upon the exeCn- tion by the person, firm or corpo- ration seeking to file the Prop- erty Division Map of an agree- ment substantially in conform- ance, with Section 11 -3133 of this Code, together with the filing of the bond required in said sec- tion. In either case, the Planning Board may set time limitations , within which the street construc- tion, improving, dedications or reservations for public use must be accomplished; provided, furth- er, that any division of land which results in the creation of four (4) or less parcels, all of which are incapable of being used as lots as defined herein, shall not require the submission of such Property Division Map In. lieu thereof a map in a form' acceptable to the City Engineer and City Planning Director of the City of Alameda shall be sub- mitted and approved jointly by said Engineer and Planning Di- rector if found to be in compli- ance with the zoning and sub- division laws of the City of Alameda. Section 4. The final paragraph of Section 11 -319 of the Alameda Mu- nicipal Code commencing with the words "The Tentative Map of the division of a unit " and ending with the words " or reservations for public use must be accomplisbed," is hereby repealed in its entirety, Section 5. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. FRANZ S.
