Ordinance 1388ORDINANCE NO. 1388 AN ORDINANCE AMENDING ORDI- NANCE NO. 1257 N. S. (ADOPTION OF UNIFORM BUILDING CODE, 1955 EDITION) RELATING TO BLAST AND /OR FALL -OUT SHEL- TERS (AMENDMENT NO. 2 — EMERGENCY MEASURE). BE IT ORDAINED BY THE COUN- CIL. OF THE CITY OF ALAMEDA: SECTION 1. That Ordinance No. 1257 N. S. of the City of Alameda which adopts the Uniform Building Code, 1955 Edition Volume 1, as the Building Code of the City of Ala- meda, among other thing's, is hereby amended by adding thereto Section 14.2, which shall read as follows: SECTION 14.2, That the Uniform Building Code, 1955 Edition, Volume 1, as adopted by the City of Ala- meda, is hereby amended by add- ing thereto a new Section which shall read as follows: SECTION 107 NOTWITHSTANDING, anything to the contrary contained within the Uniform Building Code, blast and /or fall -out shelters intended as protective structures or devices against the effects of nuclear war may be constructed subject only to the following requirements: 1. Adherence to sppecial rules and regulations relating to said con- struction as promulgated by the City Engineer of the City of Alameda which will not be detrimental to public health and safety, and are substantially in conformance with current and existent specifications and plans of such structures or devices as promulgated by the Office of Civil and Defense Mobilization. 2. That such structures or devices shall be constructed, utilized, and maintained primarily for the purpose of blast and /or fall-out shelters and not as ad- ditional area for normal human habitation. 3. The permits required by the Uniform Building Code shall be acquired, and the necessary fees paid. Normal inspections pur- suant to the Uniform Building Code shall be made to certify adherence to the rules and reg- ulations of the City Engineer. 4. For the purposes of this section a blast and /or fall -out shelter is defined as any structure or device within or without a building designed, constructed, utilized, and maintained as a protective structure or device against the effects of fire, heat, blast, concussion, or the fall- out of radioactive elements re- sulting from nuclear or other explosions or any similar de- vice. 5. Adherence shall be made to zoning laws, and other laws. rules, and regulations of the City of Alameda. SECTION 2. That this ordinance is hereby declared to be an ordinance enac'ed in great urgency and neces- sity for the public. peace, health, and safety. This declaration is based upon the fact that the City of Alameda is immediately threatened with the danger of a nuclear war, and that for the preservation of the public peace, health, and safety it is neces- sary that provisions for the construe - Lion of blast and /or fall -out shelters be immediately incorporated into the Building' Code of the City of Ala- meda in order that the construction of such protective structures or de- vices may proceed without delay. SECTION 3. This ordinance being enac for the immediate preserva- tion of the public peace, health, and safety is being introduced and passed at one and the same meeting', and shall become effective immediately.
