Ordinance 1389ORDINANCE NO. 1389 AN ORDINANCE AMENDING CHAP- TER 1, TITLE XI, OF THE ALA - MEDA MUNICIPAL CODE (ZON- ING PRO'V'ISIONS), ALL RELAT- ING TO BLAST AND /OR FALL- OUT SHELTERS (EMERGENCY). BE IT ORDAINED BY THE COUN- CIL OF THE CITY OF ALAMEDA as follows: SECTION 1. That Chapter 1, Title XI, of the Alameda Municipal Code is hereby amended by adding there- to a new Section, 11 -14A9, which shall read as follows: SECTION 11 -14A9, BLAST AND /OR FALL - OUT SHELTER, E X C E P- TIONS. NOTWITHSTATTDING anything to the contrary contained within the zoning laws and regulations of this Chapter, blast and /or fall -out shelters may be constructed and utilized within the City of Ala - meda subject only to the following requirements: 1. Setbacks. If any part of said shelter is constructed more than three (3) feet above the natural grade of the immediately sur- rounding ground surface, all set -back requirements of the District in which such shelter is located shall be met; otherwise there shall be no set -back re- quirements. 2. Lot Area (Coverage). If any portion of said shelter is con- structed snore than three (3) feet above the natural grade of the immediately surrounding ground surface, all lot and area and coverage requirements of the District in which such shel- ter is located shall be met; otherwise there shall be no lot area or coverage requirements. 3. For the purposes of this section a blast and /or fall -out shelter is defined as any structure or device within or without a building designed, constructed, utilized, and maintained as a protective structure or device against the effects of fire, heat, blast, concussion, or the fall- out of radioactive elements re suiting from nuclear or other explosions ar any similar de- vice; said shelter being con- structed in conformance with the Building Code of the City of Alameda. SECTION 2. This ordinance is here- by declared to be an ordinance en- acted in great urgency and necessity for the public peace, health, and safe- ty. This declaration is based upon the fact that the City of Alameda is immediately threatened with the danger of a nuclear war, and that for the preservation of the public peace, health, and safety it is neces- sary that provisions for the location of blast and /or fall -out shelters with- in existing zoning districts be hn- mediately provided for in the zoning laws of the City of Alameda in order that such protective structures or devices may be so located without delay. SECTION 3. This ordinance being enacted for the immediate preserva- tion of the public peace, health, and safety is being introduced and passed at one and the same meeting, and shall become effective immediately.
