AN ORDINANCE AUTHORIZING
THE EXECUTION OF AN AGREE -
MENT AND LEASE BY AND BE-
TWEEN THE CITY OF ALAMEDA,
AS LESSEE, AND THE ALAMEDA
UNIFIED SCHOOL DISTRICT, AS
LESSOR, SAID LEASE RELATING
TO THE PREMISES FOR SWIM -
MING POOLS AND RELATED
FACILITIES AT ENCINAL HIGH
SCHOOL, AND SAID AGREEMENT
RELATING TO THE SHARING OF
COSTS OF CONSTRUCTION AND
OTHER NECESSARY COSTS, AND
THE OPERATION AND USE OF
SAID SWIMMING POOLS AND
RELATED FACILITIES.
WHEREAS, Alameda Unified School
District, a public body, hereinafter
referred to as ` "Lessor," has offered
to lease to the City of Alameda, here-
inafter referred to as "Lessee," cer-
tain real property situate 'n the City
of Alameda, which real property is
more particularly described in the
form of Agreement and Lease, here-
inafter referred to, for the purpose
of constructing and maintaining
thereon a recreation center for a
term of forty (40) years from the
date of execution of said Agreement
and Lease; and
WHEREAS, a form of Agreement
and Lease setting forth the terms,
covenants and conditions stipulated
and agreed upon between the Lessor
and Lessee has been filed with the
City Clerk of the City of Alameda,
marked "Filed Dec. 5, 1961 "; and
WHEREAS, the Council is aware of
the contents of said Agreement and
Lease, and the execution of said
Agreement and Lease is deemed to
be in the best interests of the City
of Alameda;

NOW THEREFORE; BE IT OR-
DAINED BY THE COUNCIL OF THE
CITY OF ALAMEDA:
Section 1. That the form of Agree-
ment and Lease referred to above
and the terms, conditions and cove-
- nants contained therein are hereby
approved.
Section 2. The Mayor of the City of
Alameda is hereby authorized to exe-
cute, for and on behalf of the City
of Alameda, an Agreement and Lease
substantially in the form and con-
taining the terms, covenants and
conditions referred to in said Agree-
ment and Lease filed with the City
Clerk, The City Clerk of the City of
Alameda is hereby directed to attest
to same.
Section 3. This ordinance shall be
in full force and effect from and
rafter the expiration of thirty (30)
days from the date of its final
passage.

I, the undersigned, hereby certify

Call and President Collischonn; '(3).
NOES: Councilmen Godfrey and
Schacht, (2).
ABSENT: None.
