Ordinance 1407ORDINANCE NO. 1407 An ordinance authorizing execution of an amendment of certain leases between the city of alameda and barnes and tibbitts shipbuilding and drydock co made pursuant to ordinance no 168 NS WHEREAS, pursuant to the provi- sions of Ordinance No. 168 New Series, passed by the Council of the City of Alameda on March 2, 1920, the City of Alameda executed two certain leases of tide and submerged lands described in said ordinance as follows: (a) Lease dated May 11, 1920, be- tween the City of Alameda, as Lessor, and Barnes and Tibbitts Shipbuilding and Drydock Co„ as Lessee, for a term of 25 years, commencing with the 3rd day of May, 1920 and ex- piring on May 2, 1945, at a tonal rental of $22,500.00, payable in in- stallments of $900.00 each, annually in advance, on the 3rd day of May each and every year thereafter dur- ing said term. (b) Renewal Lease dated March 16, 1921 between City of Alameda, as Lessor, and Barnes and Tibbitts Ship- building and Drydock Co., as Lessee, for a term of 25 years, commencing with the 3rd day of May, 1945 and expir ng on May 2, 1970, at a total rental of $22,500.00, payable in in- stallments of $900.00 each, annually in advance, on the 3rd day of May each and every year thereafter dur- ing said renewal term; and WHEREAS, through various assign- ments, the present successor in inter- est to Burnes and Tibbitts Shipbuild- ing and Drydock Co. under the above described leases is the United States of America; and WHEREAC, under a sublease from a sublessee of the United States of America, the City of Alameda con - strueted and now maintains certain boat docks and floats over a parcel of the lands covered by the said Lease of May 11, 1920 and Renewal Lease of March 16, 1921; and WHEREAS, the sublease referred to above expired on March 14, 1962; and WHEREAS, the City of Alameda desires to continue its occupancy of said parcel by continuing to main- tain said docks and floats thereon, and the United States of America is willing to surrender said parcel pared and filed with the City Clerk of the City of Alameda marked, "Filed June 19, 1962 "; and WHEREAS, the Council is aware of the conten *s of said lease amend- ment, and its exoeution is deemed to be in the best interests of the City of Alameda; NOW THEREFORE, BE IT OR- DAINED BY THE COUNCIL OF THE CITY OF ALAMEDA: SECTION 1. That the form of lease amendment referred to above and the covenants and agreements con - tain-d therein are hereby approved. SECTION 2. The Mayor of the City of Alameda is hereby authorized to execute, for and on behalf of the City of Alameda, a lease amend- ment substantially in the form and containing the covenants and agree - ments referred to in said lease amendment filed with the City Clerk, and the City Clerk is hereby di- reeled to attest to same. SECTION 3. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. FRANZ S.
