AN ORDINANCE AUTHORIZING
EXECUTION OF LEASE OF CER-
TAIN TIDE AND SUBMERGED
RGED
LANDS TO PACIFIC SHOPS, INC.,
A CALIFORNIA CORPORATION
WHEREAS, Pacific Shops; Inc., a
California corporation, desires to
lease certain tide and submerged
lands, containing 13.47 acres more
or Tess, described in the roan of
lease referred to herein:aelow, for
a terin of 25 years, conitnenc inp
May 3, 198;5, at a total base rental
of $228,500.00 subject to certain pe-
riodic percentage increases in said
sung during said terra, with option
of renewal for an, addi`ioiial 25
;years, but at a tonal base rental of
$280,000.00 and likewise subject to
said ,periodic - increases, for pur-
poses -which will benefit, proinote
and accommodate commerce and
navigation and which will be in
accordance with the provisions of
an Apt of the Legislature of the
State of California, approved May
24, 1917, and -Found in Statutes of
California 1917, Chapter 594, page
907 ,:a n
WHEREAS, . the Council of the
City of Alain:ed:a finds and deter -
mines :that the use of the property
proposed to be leased will be for
said purposes, and further finds
and determines that Pacific =Shops,
Inc., is the owner of uplands
abutting upon said tide and sub -
merged lands; and
WHEREAS, a form of lease con-
taining the covenants and agree-
ments to be agreed upon by and
between the City and said Pacific
Shops, Inc., has been prepared and
submitted to this Council and filed
w:th the Clerk of said City, -and
said Council is aware of and ap-
proves the contents thereof;
NOW THEREFORE, BE, IT OOR-

Section L. That the form, of lease
referred to : in the preamble here-
inabove, and the terms, conditions,
covenants and agreements fora-
tained - therein be, and. the same
hereby are, approved.
Section 2. The IVlayor of the City
of Al.azneda be, and: he hereby is,
authorized to execute, for and on
behalf of the City of Alameda; a
lease of said lands to Pacific Shops,
Inc., a California corporation, said
lease to be substantially in the
foram, and containing the terms -,
conditions, _ covenants and _ =agree-
ments set forth. in said form of
lease, and the City Clerk is hereby
directed to attest the same.
Section 3. This ordinance shall be
in full force and effect from and
after the expiration of thirty (30)
days from the date of its final
passage.
