Ordinance 1672Alameda City Ordinances Ordinance No, 1672 New Series CITY OF ALAMEDA Ordinance No. 1672 New Series AUTHORIZING PURCHASE OF CERTAIN COLNTY-OWNED REAL PROPERTY LOCATED IN VICINI- TY OF POSEY TUBE (1.149 ACRES, MORE OR LESS) WHEREAS, the County of Alameda is the owner in fee of that certain real property larnited in the City of Alame- da, more particularly de- scribed hereinbelow. consist- ing of a 1.149 acre parcel located immediately east of the George H. Posey Tube Portal building; and WHEREAS, •said real prop- erty is not required for Coun- y use, and the Board of Supervlsors of said County dICI, on June 27, 1972, adopt its Resolution No. 144432 evi- dencing its intention to sell and transfer said property to the City of Alameda, all in accordance with Section 25365, Government Code of Califor- nia; and WHEREAS, it is necessary, convenient and in the best public interest that the City purchase said real property for roadway relocation, street widening and other municipal purposes, NOW THEREFORE BE IT ORDAINED BY THE COUN- CIL OF THE CITY OF ALAMEDA that: Section 1. That the City of Alameda, a municipal corpo- ration, purchase from the County of Alameda, a body litic, for the sum of Twe- E n ed Fifty and no/100 Dollars, Nine Thousand, Two Hun- ($29,250.00), in fee simple, all that certain real property lo- cated in the City of Alameda, County of Alameda. State of California, ) )1,1 rt teu- larlv, de- scribed as follow,s; COMMENCING at a point on the westerly line or Tract 31, distant thereon South 5° 56' East (the bear- ing of said westerly line being taken as South 5° 56' East for the purpose of making this description), 20.08 feet from •a point let- tered "C", as said Tract 31 and point C are delineated and so designated on that certain map entitled "MAP OF ALAMEDA MARSH LAND as partjtioned among the owners thereof, In .the suit numbered 8923 and en- titled, Pacific Improvement Company, plaintif f vs. James A. Waymire et al., defendants, Superior Court of Alameda County, State of California," etc., filed July 30, 1900, in Book 25 of Maps at pages 74, 76 and 78 thereof Records of Alameda County. California, said point o commence- ment being also on the southerly line of Work Street, and running thence along said westerly line of Tract 31, South 5° 56' East, 391.49 feet; thence leaving said westerly line of Tract 31, South 89° 10' West. 160.77 feet to the easterly line of Webster Street, as shown on the aforesaid map; thence along said easterly line of Webster Street, North 0° 50' West, 390.00 feet to an intersec- tion thereof with the afore- aid southerly line of Work ;ireet; ihence along said southerly line of Work Street, North 89° 10' East, 125.97 feet to the point of commencement. Being a portion of Tract 32, as said tract is deline- ated and so designated on the aforesaid map. SUBJECT to that certain easement granted to East Bay Municipal Utility Dis- trict, by instrument record- ed November 8, 1951, in Book 6582 of Official Rec- ords at page 243 thereof, Records of Alameda County, California.. Section 2. That evidence of title to be acquired hereby be by grant deed from said County, and that the said sum of $29,250.00 for said acquisi- tion to be paid to the County of Alameda be appropriated from the Special Road Im- provement Fund (Account 234) to pay the purchase price of said real property.
