Ordinance 1705Ordinance No. 1705 AMENDING THE ALAMEDA MUNICIPAL CODE BY ADDING SECTIONS 9 -1415, 9 -1416 AND 9 -1417 THERETO, RELATING TO ENFORCEMENT BY POUNDMASTE.R OF ANIMAL CONTROL REGULATIONS, PRESCRIBING PENALTY FOR VIOLATION THEREOF, AND RELATING TO CITATION PROCEDURE FOR VIOLATIONS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA: Section 1. Sections 9- 1415, 9 -1416 and 9 -1417 are hereby added to the Alameda Municipal Code to read: Sec. 9 -1415. Enforcement Of- ficer. The Poundmaster, his as- sistants and deputies, are hereby declared to have the duty to en- force the provisions of Chapter 1 of this Title IX, of Chapter 5 of Title XV of this Code, and of Sec- tion 4 -223 of this Code, and they shall have the power to arrest any Person . violating any such provision; in accordance with the procedures set forth in the Penal Code of California. Sec. 9.1416. Penalties. Any per- son who violates any of the Provisions of this Code referred to in the preceding Section 9 -1415 shall be deemed guilty of a mis- demeanor and upon conviction thereof shall be punished as provided in Section 1 -411 of this Code. Sec. 9 -1417. Citation For Viola- tions Of Animal Control Regula- tions. Whenever any person is arrested for a violation of one or more of the following sections of this Code, to wit: Section 4 -223; Sections 9 -111 to 9 -133 inclusive; Sections 9- 141, 9 -144, 9- 145,9 -149, 9 -1412, and 9 -1413; and such per- son is not immediately taken before a magistrate as the Procedure therefor is prescribed in the Penal Code of California, the Poundmaster or other arrest- ing officer shall prepare and serve upon the arrestee a written notice to appear in court in the `orm -and manner provided in Sections 853.6 and following of said Penal Code. Section 2. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage.
