Ordinance 1710Ordinance No. 1710 AMENDING THE ALAMEDA . MUNICIPAL CODE BY AMENDING SECTION 2 -5313 THEREOF, RELAT ING TO AND PROVIDING FOR PAY FOR.UNUSED SICK LEAVE UPON RETIREMENT TO CERTAIN OF- FICERS AND EMPLOYEES BE IT ORDAINED BY THE COUN- CIL OF THE CITY OF ALAMEDA: Section l: Section 2 -5313 of the Alameda Municipal Code is hereby amended to read: Sec. 2 -5313, Unused Sick Leave Pay Upon Retirement, (a) Each employee, except those referred to in sub- section (e) hereof, and each full -time salaried officer, who has been continuously employed by the City for more than ten (10) years; shall upon termi- nation of such employment for any reason other than discharge therefrom as a.result of dis- ciplinary action duly imposed ,by the.Gity, be entitled to receive an amount of money equal to one per- cent 0 %) of his unused sick leave accumulated pursuant to this Ar- ticle, times his number of years of employment, times his daily salary rate; provided, however, that in no evens shall such amount exceed twenty -five: percent (25 %) of the total of such employee's or officer's unused sick leave accumulation. (b) The amount of money paid or to be paid under this section shall not for any purpose whatsoever be deemed pay, salary or compensation in the calculation of present or future pension or retirement benefits. (c) This section is adopted in accor- donce.with the terms of Memoran- dums of Understanding between the City and the following three.duly recognized employee associations, and shall become effective and implemented as of the date shown: Organization Implementation (1) Alameda Police Officers Association (1) July 1, 1973 (2) International Associ- ation of Fire Fighters Local 689 (2) July 1, 1973 (3) Alameda City Employees Association (3) January 1, 1974 The City also has a Memorandum of Understanding with the .Interna- tional Brotherhood of Electrical Workers, Local 1245, a duly recog- nized employee organization which represents certain employees of City's Bureau of Electricity. All of said agreements mentioned in this subsection were reached in accor- dance with the. provisions of the "Meyers- Milias -Brown Act" (Sec - tions 3500 and following, Govern - ment Code of.California). (d) This section shall be effecf,'±�te and implemented on and after Tanuary 1, 1974, as to all full -time salaried officers and employees of the City not represented by any of the employees associations mentioned herein. (e) By reason of the terms of the Memorandum of Understanding between the City and the said In- ternational Brotherhood of Elec- trical Workers, Local 1245, the unused sick leave pay upon re- tirement benefits provided by this Section, asset forth in subsections (a), (b),.(c) and.(d).hereinaboye, shall not be available nor paid 4o the employees of City's said Bureau of Electricity represented by said organization, the Interna- tional Brotherhood of Electrical Section 2. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. TERRY LA CROIX, JR.
