Ordinance 1729ORDINANCE 1729 AMENDING THE ALAMEDA MUNICIPAL CODE BY AMENDING SECTION 11 -14A6 BY ADDING SUBDIVISION (f) THERETO; AMENDING SECTION 11 -1226; AND ADDING SECTIONS 11 -14A10 AND 11 -14 AII THERETO, RELATING TO LOTS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA: Section 1. Section 11 -14A6 of the Alameda Municipal Code is hereby amended by adding subdivision (f) thereto to read: (f) Any lot, other than a lot of record, which does not meet the area and frontage requirements of its zone shall not be considered a legal building site unless either a variance to the area and/or frontage requirements for lots in the zone in which it is located has been approved or a Planned Development applicable to the lot has been approved. Lots not meeting the requirements of a buin s to lding site by virtue of excep- tio the Subdivision Or- dinance of the City of Alamed a approved prior to the en'.actme a approved prior to the enactment of this section shall be deemed to have received variance approval, Section 2: Section 11 -1226 of the Alameda Municipal Code is hereby amended io read: Sec. 11 -1226. Lot. Lots shall be either: (a) A parcel of real property when shown as a delineated par- cel of land with a number or other designation on a plat recorded in the office of the County Recorder prior to November 20, 1956; or (b) A parcel of land the dimen- sions of which are defined by a record of survey or tract or par- cel map recorded pursuant to the provisions of the Subdivision Map Act of the State of California in the office of the County Recorder; or (c) A parcel of real property not delineated as in subsections (a) or (b) and containing not less than the prescribed minimum requirements of a building site; defined Parcel of real Land bisected by a lot line (s) of a par- cel (s) delineated pursuant to subsection (a) or (b), the title to which, with or without en- cumbrances, is unified; or (e) A Lot of Record; (f) "Lot" shall not include a unit of a condominium as defined in the general law; (g) The above definitions are mutually exclusive. Subsections (c) and (d) shall not apply when their application would create an adiacent substandard parcel. Section 3. Sections 11 -14AI0 and 14A11 are hereby added to read: Sec. 11- 14Ai0. Corner Lots. In residential and professional district corner lot widths shall be sixty (60) feet on lots other than lots of record. Sec. 11- 14A11. Cul -De -Sat Lots. Residential lots located on curved or cul -de -sac streets, which have a minimum width at the established front yard set -back line of fifty (50) feet shall be deemed to satisfy the minimum width requirement for a residential lot. The set -back line shall be measured by the same arc established by the front lot line. Section 4. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. C.J.
