Ordinance 1730ORDINANCE 1730 AN ORDINANCE ADOPTING BY REFERENCE THE UNIFORM BUILDING CODE, 1973 EDITION, COPYRIGHT 1973 BY INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS, WITH AMEND MENTS,.ADDITIONS AND DELE- TIONS THEREOF AS THE PRIMARY CODE, APPENDIX; CHAPTER 13,35, 49 AND 57 THEREOF, AND UNIFORM BUILDING CODE STANDARDS, EACH REFERRED TO IN SAID PRIMARY CODE AS THE SECONDARY CODE: REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATON, REPAIR, MOVING, REMOVAL, CONVERSION, DEMOLITION, OC- CUPANCY, EQUIPMENT, USE, HEIGHT, AREA, AND MAINTENANCE OF BUILDINGS OR STRUCTURES IN THE CITY OF ALAMEDA; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR; DECLARING AND ESTABLISHING A FIRE DISTRICT; PROVIDING PENALTIES FOR VIOLATION THEREOF, AND REPEALING OR- DINANCE NO. 1659 NEW SERIES, AND ALL OTHER ORDINANCES AND PORTIONS OF ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA: Section 1. Title. Uniform Building Code. This Ordinance shall be known as the "Alameda Building Code," may be cited as such, and will be referred to herein as "this Ordinance" or "this Code," or "Building Code." The Uniform Building Code, as the Primary Code, and Appendix, Chapter 13, 35, 49 and 57, and Uniform Building Code Standards as the Secondary Code, Copyright 1973 by International Conference of Building Officials, copies of which have been placed on file with the City Clerk for use and examination by the public and by Resolution No. 8255 declared to be Public records, as said copies have been deleted, changed and supplemented with the approval of this Council, and each and all of the regula- tions, provisions, conditions, requirements and terms thereof are hereby adopted as the Alameda Build- ing Code for regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area, and maintenance of all buildings and structures in the City of Alameda, and by this reference are incorporated herein and made a part hereof to the same effect as though set forth herein in full. Section 2. General Standards. All materials and assemblies of materials; appliances and installation of appliances; arrangements of occupan- cies; all exits, aisles, stairs; doors and appurtenances thereto in buildings or structures shall be so arranged, as- sembled and of such size and so pro- tected as to hold to a minimum all exit, fire and health hazards. The quality of all materials, method of connecting or assembling such materials, stresses allowed and live and dead loads assumed in the design and construction of all buildings or structures shall be in accord with no- tionally recognized standards of quality and with generally recognized and well established methods of struc- tural design and construction. me reductiin of fire and exit hazards, acceptable quality of materials and generally recognized and well es- tablished methods of structural design and construction. Section 3. Changes, Additions and Deletions. The changes, additions and deletions of said Uniform Building Code, placed on file with the City Clerk, hereinafter set forth and designated are hereby approved and adopted as follows: Section 101 is changed to read as follows: "Sec. 101. This Ordinance shall be known as the'Alamedn Building Code,' may be cited as such, and will be referred to herein as 'this Ordinance' or 'this Code,' or 'Building Code.' The following paragraph is added to Section 303 (a) to read as follows: "Permit fee for demolishing buildings or structures shall be S5.00 for each permit." "Permit fee for reroofing shall be S5.00 for each permit." The following paragraph is added to Section 303 (b) to read as follows: "Plan- checking fee shall be $10.00 for identical buildings as in a subdivision or tract. This is applicable only when each building is to be constructed from identical plans and specifications as approved for the original struc- ture." Whenever in said Building Code the words "City," "Building Ins- pector," "Fire Marshal," "Building Official" or other designation of an of- ficer, board or department occur, the word "City" shall mean the City of Alameda and the word "Building Ins- pector," "Fire Marshal," "Building Official" or other designation of an of- ficer, board or department, shall mean respectively the Building Inspector, the Fire Chief, or such officer, board or department of the City of Alameda. Section 5. Validity. If any section, subsection, sentence, clause or phrase of said Building Code or of this Or- dinance is for any reason held to be un- constitutional, such decision shall not affect the validity of the remaining . portions of said Code or of this Or- dinance. The City Council hereby declares that it would have passed this Ordinance and each section, subsec- tion, clause or phrase thereof irrespec- tive of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared un- constitutional. Section 6. Violations and Penalties. The provisions and penalties contained and provided in Section 205 of Chapter 2 of said Building Code are hereby specifically incorporated and adopted as part of this Ordinance. In addition to the penalties herein provided, any building, structure, or portion thereof, or any condition existing or permitted to exist in violation of any provision of said Building Code, or any actual or threatened violation of said Code, may be abated, restrained or adjoined in any manner provided by law; provided, further, that the penalties set out in Section 1 -411 of the Alameda Municipal Code are specifically applicable herein and may be applied cumulatively, con- secutively, or in the alternative with any penalty set out herein. Section 7. That Ordinance No. 1659 New Series, of the City of Alameda, passed January 18, 1972, and all other ordinances and parts of ordinances of the City of Alameda in conflict herewith be, and the same are, hereby repealed. Section 8. This Ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. TERRY LA CROIX, JR.
