Ordinance 1746ORDINANCE 1746 AUTHORIZING PURCHASE BY QUITCLAIM DEED OF REAL PROPERTY LOCATED BETWEEN BUENA VISTA AVENUE AND PACIFIC AVENUE, AND BETWEEN SHERMAN STREET AND BENTON STREET (NORTHSIDE PARK) WHEREAS, Public interest and necessity require that the real property hereinafter described be acquired by the City of Alameda; and WHEREAS, ALASKA PACKERS AS- SOCIATION, INC,, a Delaware Cor- poration, is the owner of the real property hereinafter described and is willing to sell some to the City of Alameda, NOW, THEREFORE, BE IT OR- DAINED BY THE COUNCIL OF THE CITY OF ALAMEDA: Section 1. That the City of Alameda purchase from ALASKA PACKERS ASSOCIATION, INC_ a Delaware cor- poration, by quitclaim deed, that cer- tain real property situated in the Cifyof Alameda, County of Alameda, State of California, particularly described as: A portion of the land bounded by Sherman Street, formerly St, George Street, Buena Vista Avenue, Benton Street, and Pacific Avenue, as said streets and avenues are shown on the map entitled "Portion of Fitch Tract (Alameda) ", filed January 14, 1887, in Book 4 of Maps, page 31, in the office of the Alameda County Recorder and as shown on the "Mdp of 144 Lots in Page Tract, Alameda County", filed February 25, 1874, in Book 6 of Moos, page 7, in the office of the Alameda County Recorder, and more Particularly described as to I I ows: Parcel I BEGINNING of the point of intersection of the northern line of Pacific Avenue with the center line Produced of Morton Street, formerly St. Paul Street, as said avenue and street are shown on said Maps; THENCE along the direct Production westerly of said northern line, North 85 West, 10.77 feet to the most southern corner of that certain Parcel of land as described in the Judgment quieting title, Suit No 288345, in the Superior Court of the State of California, recorded January 14, 1959, in Book 8901 Page 117, Official Records ci Alameda County; THENCE along the eastern boundary of said parcel, North 2'59'10" East 150.04 feet to a Point on a southern boundary of that certain 3.6 acre parcel of land described in the decree vesting title, dated March 26, 1943, in the U.S. District Court for the Northern District of California, Southern Division Suit No. 22546-G, United States oi America vs. Alaska Packers Au- SOC[OtiOn, a corporation, et al, a certified copy of which was recorded April 10. 1941 in Book 4357, page 291, Official Records of Alameda County; THENCE along the last said line South 85 East, 1L5 feet, more or less, to a point in a southwestern boundary of that certain parcel of land as described in the deed to Alaska Packers Association dated December 3, 1929 and recorded December 17, 1934, in Book 3120, page 318, Officiate Records of Alameda County; THENCE southerly along lost said boundary, 150 feet, more or less to the BEGINNING. Parcel 2 COMMENC I NG at the paint of intersection of the eastern line of Sherman Street with the southern line of Buena Vista Avenue, as said street and avenue are shown on the aforesaid maps; THENCE southerly along said line of Sherman Street, 150 feet to the TRUE POI NT OF BEGI N- NING; THENCE southeasterly 328 feet along a southwestern boun- dary line of that certain parcel of land described in the deed to Alaska Packers Association dat- ed December 3, 1929 and record- ed December 17, 1934, in Book 3120, Page 318, Official Records of Alameda County; THENCE southerly along a western• boundary line of said parcel, 9 feet, more or less, to a point on a southern boundary of that certain 3.6 acre parcel of land described in the decree vesting title, dated March 26, 1943, in the U.S. District Court for the Northern District of California, Southern Division, Suit No, 22546-G, United States of America vs. Alaska Packers As- sociation, a corporation, et al, a certified copy of which was recorded April 10, 1943, in Book 4357, page 291, Official Records of Alameda County; THENCE westerly along said southern boundary, 328 feet, more or less, to the TRUE POINT OF BEGINNING. That the sum of $195,000, together with a sum sufficient to pay the cost of title insurance and other in- cidental expenses of sold acquisition be appropriated from Revenue Sharing Funds (Acc No. 355) to Pay the purchase price of said real property, together with the real property described in Ordinance No. 1745, N,S., cost of said insurance and incidental expenses.
