Ordinance 1801ORDINANCE 1801 AMENDING THE ALAMEDA MUNICIPAL CODE BY AMENDING AND ADDING CERTAIN SECTIONS TO ARTICLES 3 AND 4, CHAPTER 2, TITLE XI THEREOF, RELATING TO DESIGN REVIEW.REGULATIONS AND SPECIAL PROVISIONS BE IT ORDAINED BY THE COUN- CIL OF THE CITY OF ALAMEDA that: Section 1. Article 3, Chapter 2, Title XI of the Alameda !Municipal Code is hereby amended by amending Sections 11 -231, 11 -233, 11 -234 and 11 -235 thereof to read as follows: Sec. 11 -231. Improvements Subject to Review. (a) Each improvementfor which a building permit, relocation permit, condominium conversion permit or advisory opinion or report to the Planning Board is required shall be approved as provided in this Chapter unless exempted herein. (b) "Improvement'' shall mean the construction or reconstruction, alteration or repair of the exterior of buildings, structures or facilities af- fixed to real property. (c) "Minor improvement'' shall mean an improvement which is either small 'in scope or, because of its location, has little potential im- pact on its neighborhood. (d) The following improvements are exempt from the provisions of this Chapter: (1) Additions or repairs to an existing improvement if no struc- fural change to the exterior thereof is to be made. (2) Improvements to single family dwellings not visible from any Street. Sec. 11 -233. Fee Schedule. The application shall be accompanied by a fee of: (a) For commercial and indus- trial uses 5100.00 (b) For residential uses 25.00 (c) Minor improvements No Charge Said fees are for the purpose of ad- ministering this Chapter and not for revenue. Sec.: 11 -234. Administrative Approval (a) The Secretary of the Design Review Board may approve an application under the following con- ditions: (1) `The Secretary finds ihat the project is a minor improvement; (2) The Secretary finds that the project substantially complies with Section 11 -236 (a); (3) The applicant agrees to all conditions required by the Secre- tary; and (4) The Secretary approves the project within three (3) days of the filing thereof. (b) Where a decision has been rendered by.the Secretary, any per - son may appeal such action by filing a notice of appeal with the Secretary of the Board within ten (10) days from the date of decision of the Secretary. (c) The Board shall hear appeals under Section 11 -234 (b) as original applications. Sec. 11 -235. Action on Applica- tions. (a) The Board shall approve or conditionally approve, within a reasonable time, applications either referred to it by the Planning Board for approval or which do not require Planning Board approval where said applications meet the requirements of Section 11 -236 (a), All other applications shall be denied pur- suant to Section 11 -236 (b). (b) Applications referred to the Board for an advisory opinion or report shall be reported on for con- formance with the standards of the Design Review Manual and the report shall be forwarded to the Planning Board as soon as practica- ble, Said report shall include exhibits sufficient in detail to define the improvements reviewed by the Board and recommended conditions of approval. (c) The Design Review Board shall not alter matters approved by the Planning Board. Section 2. Article 3, Chapter 2, Title XI of the Alameda Municipal Code is hereby amended by adding subsection (h) to Section 11 -232, and Sections 11 -236 and 11 -237 thereto to read as follows: Sec. 11 -232. Applications for Review of Design. (h) Applications for minor improvements shall.o €ily.require the above !terns requested by the Secre- tary of the Design. Review Board. Sec. 11 -236:: Requirements: (a) Projects must be compatible with their site any adjacent or neighboring buildings or surround - ings and promote harmonious tran- sitions in scale and character .in areas between different designated land uses: (b) Projects which do not meet the requirements of subsect ion (a) shall be presumed detrimental to either existing property values or the growth of property values in the vicinity of the project. (c) The Design Review Board may determine compliance with subsec- tion (a) by determining the consis- tency of the project with the prin- ciples and standards of the Design Review Manual. Sec. 11 -237: Expiration and Exten- sion. Unless construction has com- menced within six months of the approval hereunder, approval shall expire unless an extension is granted by the Board prior to said expira- tion. Section 3. Article.4, Chapter 2, Title XI of the Alameda Municipal.Code is herebv.amended by amending Section 11 -245 thereof to read as follows: Ord Alameda CI*ty Ordinance No, (� i I New Series Sec. 11 -245. ''Design Review Manual" — Preparation by Board. It shall be the duty of the Board to prepare a "Design Review Manual" that will provide guidance to applicants seeping to comply with Sec. 11 -236 (a) of this Chapter. Said Manual may separate residential, commercial and industrial uses by sections or constitute a separate manual for each of said uses. Graphic illustrations maybe used as exampi` s of good or bad design and such examples need not be limited to improvements within the City. Said Manual may be revised as experience dictates and examples of approved proiects considered suc- cessful by the Board should be included therein. Copies of said Manual shall be made available to the public in the Secretary's office. The City Council may review the Manual at such times as it deems appropriate and approve or disapprove any part thereof. Section 4. This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage. C. J. CORICA Presiding Officer of the Council Attest: ETHEL. M.
