Ordinance 1890CITY OF ALAMEDA ORDINANCE NO. 1890 New Series AUTHORIZING APPROVAL AND EXECUTION OF SETTLEMENT AGREEMENT BETWEEN CITY AND HARBOR BAY ISLE ASSOCIATES RELATING TO PUBLIC LANDS OBLIGATIONS OF HARBOR BAY ISLE ASSOCIATES FOR ITS 915 ACRE PROJECT ON BAY FARM ISLAND WHEREAS, settlement of the controversies between the City of Alameda and Harbor Bay Isle Associates, including but not limited to Fill Agreements, the City's Dwelling Unit Tax, the Memorandum of Understanding between the parties together with the Alameda Unified School District, and legal require- ments concerning public access to the Bay edge and improvements thereon, as further set out in the recitals to the agreement approved herein, mould facilitate the development of Bay Farm Island; and WHEREAS, a certain form of agreement containing the provisions to be agreed upon by and between the City of Alameda and Harbor Bay Isle Associates, in connection with public lands obligation of Harbor Bay Isle Associates for its 915 acre project on Bay Farm Island, has been prepared and submitted to this Council at a regular meeting held October 18, 1977, and placed in the office of the City Clerk, marked "Filed, October 18, 1977." NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that: Section 1 . The form of agreement referred to herein and the agreements and provisions thereof be, and the same are hereby, approved. Section 2 . The Mayor of the City of Alameda is hereby authorized and directed to execute, and the City Clerk to attest, as the act and deed of the City of Alameda, an agree- ment substantially in the form and containing the agreements and provisions set forth in the aforesaid form of agreement. Section 3 . This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage.
