Ordinance 1892CITY OF ALAMEDA ORDINANCE NO. 1892 New Series AUTHORIZING THE TRANSFER OF CERTAIN REAL PROPERTY IN THE CITY OF ALAMEDA BETWEEN THE CITY AND HARBOR BAY ISLE ASSOCIATES (OTIS DRIVE PROPERTY AND HBI PARK) WHEREAS, the City of Alameda is the owner of certain real property situate in the City of Alameda, County of Alameda, State of California, herein called the "Otis Property," and hereinafter described; and WHEREAS, Harbor Bay Isle Associates, a partnership com- prised of Doric Development, Inc., a California corporation, and Bay Farm Island, Inc., a Nevada corporation, is the owner and developer of that certain project commonly known as Harbor Bay Isle in the City of Alameda, County of Alameda, State of California, and the development plan for Harbor Bay Isle includes a park, located adjacent to the proposed Harbor Bay Isle shopping center, herein referred to as "HBI Park "; and WHEREAS, Harbor Bay Isle Associates is willing to exchange the land designated as HBI Park for the Otis Property; and WHEREAS, the Otis Property is no longer required by the City for municipal purposes; and WHEREAS, the City of Alameda and Harbor Bay Isle Associates have entered into an agreement to exchange the Otis Property and HBI Park, all as more particularly set out in the Agreement to Exchange Real Property dated April 26, 1977 and authorized by Council Resolution No. 8691 adopted on April 5, 1977; and -1- WHEREAS, Harbor Bay Isle Associates has waived the con- ditions precedent to said Agreement if conveyance can be madE immediately; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA: Section 1 . That the City of Alameda, for the exchange value and upon the terms and conditions set forth in the Agree- ment to Exchange Real Property, dated April 26, 1977 and authorized by Council Resolution No. 8691 adopted on April 5, 1977, does hereby transfer unto Harbor Bay Isle Associates, a partnership comprised of Doric Development, Inc., a California corporation, and Bay Farm Island, Inc., a Nevada corporation, all that certain real property situate in the City of Alameda, County of Alameda, State of California, and more particularly described as follows: Lot 3, Block 11, Tract 1898, South Shore Unit No. 2, filed August 22, 1958, Map Book 38, Pages 89 to 92, Alameda County Records. Section 2 . That the Mayor of the City of Alameda is hereby authorized and directed to execute, for and on behalf of the City of Alameda, a quitclaim deed conveying said real property to Harbor Bay Isle Associates, and the City Clerk is directed to attest to the same. Section 3 . This ordinance is one of great necessity and urgency within the meaning of Section 3 -12 of the City Charter, -2- is introduced and passed at the same Council meeting, and shall become effective on November 16, 1977. Section 4 . The facts constituting the necessity and L •z N 0 in � 1- d ci. 4; urgency hereof are: (1) Financial considerations make it advantageous for both parties to close escrow immediately.
