AMENDING THE ALAMEDA MUNICIPAL CODE BY AMENDING
FEE SCHEDULES
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that:
Section 1 . The fees and charges contained in the Alameda
Municipal Code, and as set out in Exhibits A, B and C, attached
hereto and incorporated herein as if set forth in full, are
hereby amended and /or established.
Section 2 . This ordinance is hereby declared to be an
ordinance enacted in great necessity and urgency. This declara-
tion is based upon the facts that:
(1) Proposition 13, adopted at the June 6, 1978, Primary
Election of the State of California, requires a special election
for the establishment of a special tax.
(2) Although it is the opinion of the City Attorney that
this ordinance does not pertain to special taxes, the question
is one which will ultimately be decided by the Courts.
(3) Additional revenues are needed by the City.
(4) All fees and charges listed in Exhibits A and B of
this ordinance were approved by the Council at a Special Meeting
held on June 26, 1978.
Section 3 . Pursuant to Section 3 -12 of the City Charter,
this ordinance, being enacted in the event of great necessity, is
being introduced and passed at one and the same meeting and

shall become effective immediately.
Section 4 . The fees and charges adopted herein shall be
codified at a later date.

Alameda in special meeting assembled on the 30th day of June, 1978 by the

President Corica, (4).
NOES: None.
ABSENT: Councilman Beckam, (1).

The fee for an application for rezoning to more than
one zoning classification shall
be the total of the separate fees for each zoning classification.
No filing fee shall be required for an application made by the Planning Board or
by and for the direct use of any governmental jurisdiction
organized under the
laws of the State of California or the laws of the United States. This exception
shall not apply to a non - governmental lessee of governmentally owned land.
Fees may be waived by the City Council or Planning Board to avoid duplication of
charges on successive applications or undue hardship.
No part of any such fee shall be returnable after an
application is filed and such
fee paid, except upon petition by the applicant and
approval by the Planning Board.
