Ordinance 1962CITY OF ALAMEDA ORDINANCE NO. 1962 New Series AN ORDINANCE AMENDING SECTION 11 -14B9 OF THE ALAMEDA MUNICIPAL CODE AND DECLARING THE COUNCIL'S PRIORITY FOR THE ENFORCEMENT OF SAID REGULATIONS WHEREAS, the City Council has adopted off- premise adver- tising regulations; and WHEREAS, said regulations were promulgated as eight (8) separate and distinct regulations; and WHEREAS, all of said regulations have been challenged in legal proceedings; and WHEREAS, license tax ordinances for billboards and space for billboards have also been challenged in consolidated legal proceedings, and WHEREAS, the Court may desire to know, for purposes of reviewing the cumulative effects of the regulations, the Council's preferences for enforcement of said regulations; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that: Section 1 . The priority for enforcement of off - premise regulations is as follows: A. The fifty (50) square foot limit (Sec. 11- 14B9(a); B. The prohibition on roofs (Sec. 11- 14B9(b); C. Prohibiting their use in residential and C -1 zones; D. Visible as background to traffic signals (Sec. 11- 14B9(f); E. One thousand (1,000) foot separation (Sec. 11- 14B9(c); -1- F. Visible in residential areas, and G. Scenic routes (Sec. 11- 14B9(g). Section 2 . Sec. 11- 14B9(c) of the Alameda Municipal Code is hereby amended to read: (c) Be located within: (i) 1,000 feet of another off - premise out- door advertising sign which does not conform to the provisions of subsection (a) where both of said signs do not conform to the provisions of subsection (a), or (ii) 100 feet of another off- premise out- door advertising sign where one or both of said signs conform to the provisions of subsection (a). Section 3 . Sec. 11 -1439 of the Alameda Municipal Code is hereby amended by adding subsection (j) to read: (j) The provisions of subsections (d) and (e) shall not apply to signs which conform to the provisions of subsection (a). Section 4 . Severability If any provision of this ordinance or the application thereof to any person or circum- stance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this ordinance are declared to be severable. Section 5 .
