AMENDING THE ALAMEDA MUNICIPAL CODE BY AMENDING
SECTION 5 -264.1 OF ARTICLE 6, CHAPTER 2, TITLE V
THEREOF RELATING TO ADMINISTRATIVE PROCESSING OF
REVOCABLE ENCROACHMENT PERMITS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ALAMEDA that:
Section 1 . The Alameda Municipal Code is hereby amended
by amending Section 5 -264.1 of Article 6, Chapter 2, Title V
thereof to read:
Sec. 5- 264.1 Exceptions The provisions of Section
5 -264 shall not apply to any obstruction or encroachment
upon issuance of a revocable encroachment permit by the
Superintendent of Streets. The Superintendent of Streets
may grant the encroachment permit taking into considera-
tion the utilities underground and the safety, planning
requirements, and needs of the City. Before issuing an
encroachment permit the Superintendent of Streets shall
find that the permit will not substantially interfere with
the public health, safety or welfare. In granting the
permit the Superintendent of Streets may attach such terms
and conditions as he deems necessary to carry out the
intent of this section. The decision of the Superintendent
of Streets may be appealed to the City Council by submitting
a letter to the City Clerk within ten (10) days of the
decision.

Section 2 . This ordinance shall be in full force and
