AUTHORIZING EXECUTION OF MODEL FRANCHISE AGREEMENT
WITH OAKLAND SCAVENGER COMPANY FOR THE COLLECTION
AND REMOVAL OF REFUSE AND GARBAGE
WHEREAS, there has been submitted to this Council a Model
Franchise Agreement between the City of Alameda and Oakland Scavenger
Company for the collection and removal of refuse and garbage for
a period of twenty (20) years, from June 1, 1982; and
WHEREAS, the City Council is familiar with the contents of
said agreement; and
WHEREAS, it is in the public interest that said agreement
be entered into;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF ALAMEDA that:
Section 1. The Model Franchise Agreement referred to herein
and the terms, conditions and agreements contained therein, be,
and the same are hereby, approved.
Sectio 2. The Mayor of the City of Alameda be, and he is
hereby authorized to execute, for and on behalf of the City of
Alameda, said Model Franchise Agreement for the collection and
removal of refuse and garbage in the City of Alameda and the City
Clerk is hereby authorized and directed to attest to same.
Section 3 . Upon the execution of said Model Franchise
Agreement and upon its effective date, to - -wit, on the 1st day of
June, 1982, that certain Solid Waste Disposal Agreement between
the City of Alameda and Oakland Scavenger Company entered into on
April 1, 1981, pursuant to an Agreement for Assumption of Obliga-
tions and Liabilities under Solid Waste Disposal Agreement, together
with the assumed Franchise Agreement with Alameda City Disposal,
effective the lst day of October, 1978, shall cease, terminate and
be deemed canceled as of said date.
Sect 4 . The City Council hereby finds that the issuance
of an exclusive franchise will insure that all dwelling units and
business establishments obtain the use of a qualified collection
service and that carbace and refuse will thereby be transported
within the City in a safe and sanitary manner and deposited only
at approved sites.

Section 5. This ordinance shall be in full force and
effect from and after the expiration of thirty (30) days from the
date of its final passage.

and regularly introduced and adopted by the Council of the City of Alameda
in regular meeting assembled on the 6th day of April, 1982, by the following
vote, to wit:
AYES: Councilmen Diament, Gorman, Sherratt, Stone and President Corica - 5.
NOES: None.
ABSENT: None.
