DETERMINING AND DECLARING THE NEED FOR AN INDUSTRIAL
DEVELOPMENT BOND AUTHORITY TO FUNCTION IN THE CITY
OF ALAMEDA
that there is a community need for an industrial development
authority in the City of Alameda;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF ALAMEDA that:
1. The Council of the City of Alameda does hereby declare
that there is a need for an industrial development authority and
such an authority shall function within the City of Alameda
pursuant to the California Industrial Development Financing Act,
Sections 91500 et seq. of the Government Code of the State of
California.
2. The City Council hereby declares itself to be the Board
of the Industrial Development Authority of the City of Alameda
pursuant to said Sections of the Government Code and finds such
action will serve the public interest. The City Council further
declares that all of the rights, powers, privileges, duties, lia-
bilities, disabilities, and immunities of the said Act are vested
in the City Council.
3. The authority created herein is designated as the
"Industrial Development Authority of the City of Alameda."
4. If any section, subsection, sentence, clause, or phrase
of this ordinance is for any reason held to be invalid, such
decision shall not affect the validity of the remaining portions
of this ordinance. The City Council hereby declares that it should
have adopted the ordinance and each section, subsection, sentence,
clause, or phrase thereof, irrespective of the fact that any one
or more sections, subsections, sentences, clauses, or phrases be
declared invalid.
5. This ordinance shall be in full force and effect from
and after the expiration of thirty (30) days from the date of its
final passage.
