Ordinance 2140CITY OF ALAMEDA ORDINANCE NO. 2140 New Series AMENDING THE BUSINESS LICENSE TAX OF THE CITY OF ALAMEDA RELATING TO TELEVISION SUBSCRIPTION SERVICE WHEREAS, it was the intention of the City Council that Ordinance No. 1991 New Series apply to cable television (community anenna systems) providers; and WHEREAS, it is still the intention of the City Council that the said business license tax apply to cable television providers; and WHEREAS, the Superior Court reads the grammar of said ordinance to exclude cable television, the Council adopts this ordinance to remove any doubt that the tax did and does apply to cable television; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA: Se ction 1 . The Alameda Municipal Code is hereby amended by amending Section 13- 111(s) of Article 1 and Section 13- 1951(c) of Article 9 of Chapter 1, Title XIII, thereof, to read as follows: Sec. 13 -111. (s) Television Subscription Service "Television subscription service" shall mean a business that sells rights to or subscriptions for the receipt of television signals not available by use of standard antennae. Television subscription service includes, but is not limited to, community antenna television systems or other antenna systems required to receive satellite signals or any signal which requires the use of a specific antenna or decoding or unscrambling device whether delivered to the consumer by means of cable or otherwise.
