APPROVING AND AUTHORIZING EXECUTION OF LEASE OF REAL
PROPERTY BETWEEN CITY, AS LESSOR, AND ALAMEDA SWIMMING POOL
ASSOCIATION, AS LESSEE, FOR SWIMMING POOL FACILITIES
AT LINCOLN AND FRANKLIN PARKS
(REQUIRES FOUR AFFIRMATIVE VOTES)
WHEREAS, the City of Alameda and the Alameda Swimming Pool
Association, a non - profit corporation, previously entered into a lease of certain
City owned properties, being portions of Franklin Park and. Lincoln Park; and
WHEREAS, the City of Alameda and the Alameda Swimming Pool
Association now desire to enter into a new lease for the same properties; and
WHEREAS, the term of this Lease shall be for ten (10) years,
expiring on September 30, 2021; and
WHEREAS, the proposed lease does not have a significant effect
on the environment, and therefore, is exempt under Section 15301 (e) (1 ) of the
CEQA (California Environmental Quality Act) Guidelines; and
WHEREAS, a form of lease containing the covenants, terms and
conditions to be entered into is on file in the office of the City Clerk of the Cit y of
Alameda; and
WHEREAS, pursuant to City Charter Article XXII Sec. 12, the City
Council may lease public park property; and
WHEREAS, pursuant to City Charter Article 111 Sec. 10, no real
property of the City shall be leased for a period in excess of one year except on
the affirmative vote of four members of the Council.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Alameda, and upon the affirmative vote of four members of the City Council
that:
Section 1 The City Council of the City of Alameda hereby
approves and authorizes the City Manager to execute the Lease of Real Property

between the City of Alameda, as Lessor, and Alameda Swimming Pool
Association, as Lessee, for Swimming Pool Facilities at Lincoln and Franklin
Parks.
Section 2. This ordinance shall be in full force and effect from
and after the expiration of thirty (30) days from the date of its final passage.
