Resolution 14676CITY OF ALAMEDA RESOLUTION NO. 14676 OPPOSE AB 391 (PAN) A BILL RELATED TO ELECTRONIC REPORTING FOR SECONDHAND DEALERS AND PAWNBROKERS WHEREAS, AB 391 (Pan), "Secondhand Dealers and Pawnbrokers: Electronic Reporting," is a bill currently pending in the State Senate; and 0 WHEREAS, if enacted, AB 391 could have a significant negative financial 4. impact on the Alameda Point Antiques Faire and other similar enterprises; and c WHEREAS, AB 391 would require all licensed secondhand dealers and coin dealers to pay a biennial fee of no more than $300 to create and maintain a statewide electronic database into which each dealer would be required to report "all secondhand tangible personal property, except for firearms, which he or she has purchased, taken in trade, taken in pawn, accepted for sale or consignment, or accepted for auctioning, to the chief of police or to the sheriff" of the jurisdiction; and WHEREAS, the reporting, which includes such information as the identification of the seller of the property, a description of the property, and a fingerprint of the seller, among other things, would be required within 24 hours of the acquisition of the goods; and WHEREAS, secondhand dealers are already required to hold all acquired reportable tangible personal property for 30 days before reselling it, and these reporting requirements are enforced at the discretion of local jurisdictions; and WHEREAS, passage of this bill could have a chilling effect on the buying and selling of antiques, collectibles and used merchandise since the timeframes and regulations in the bill could prove difficult for small independent business persons to comply with appropriately. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Alameda opposes AB 391 (Pan), "Secondhand Dealers and Pawnbrokers: Electronic Reporting.
