Resolution 14714CITY OF ALAMEDA RESOLUTION NO. 14714 APPROVING A NEW AGREEMENT PROVIDING FOR IMPLEMENTATION OF THE ALAMEDA COUNTYWIDE CLEAN WATER PROGRAM AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL REQUIRED AGREEMENTS AND DOCUMENTS WHEREAS, the City of Alameda (City) is a member agency of the Alameda Countywide Clean Water Program (ACCWP), formerly the Alameda County Urban Runoff Clean Water Program, and fully participates in the activities, benefits, duties and responsibilities of the ACCWP as reflected in the existing Agreement to Implement the Alameda Countywide Clean Water Program as approved in 1991 and amended in 1998, 2001, and 2004; and WHEREAS, the City is required to be permitted by an NPDES permit as prescribed by the Federal Clean Water Act with respect to discharges of storm water from its storm water drainage and collection system, and is currently included as a permittee under the California Regional Water Quality Control Board, San Francisco Bay Region Municipal Regional Stormwater NPDES Permit, Order R2- 2009 -0074 (NPDES Permit No. CAS612008); and WHEREAS, on December 6, 2011 the Management Committee of the ACCWP adopted a motion approving a new "Agreement Providing for Implementation of the Alameda Countywide Clean Water Program" for adoption by member agencies intended to: 1) establish a new 15 -year Agreement term starting July 1, 2012; 2) improve Agreement clarity by entering into a new stand -alone Agreement; 3) increase flexibility of the ACCWP's operations by allowing parties to the Agreement other than the Alameda County Flood Control and Water Conservation District to take on the roles of Fiscal Agent and /or Program Manager; and, 4) Make changes in the allocation of program costs and voting shares to reflect the way Program costs are shared and the benefits received. NOW THEREFORE, BE IT RESOLVED, that the City approves a new Agreement Providing for Implementation of the Alameda Countywide Clean Water Program and authorizes the City Manager to execute all required agreements and documents.
