AUTHORIZING THE MAYOR TO EXECUTE A GRANT DEED TO THE
STATE OF CALIFORNIA, DEPARTMENT OF TRANSPORTATION, FOR
CONVEYANCE OF THE RIGHT -OF -WAY ALONG WEBSTER STREET
AND STARGELL AVENUE, AND AUTHORIZING THE MAYOR TO
EXECUTE AN ACCOMMODATION RECORDING AGREEMENT WITH
FIRST AMERICAN TITLE COMPANY
WHEREAS, Cooperative Agreement 4 -2198, effective May 8, 2008,
between the State of California, Department of Transportation (Caltrans), and
the City of Alameda obligates the City to convey the right -of -way, to Caltrans
along with portions of Webster Street (State Route 260) and Stargell Avenue for
the Webster Street/Wilver "Willie" Stargell Avenue Improvement Project; and
WHEREAS, the recordation of the conveyance by Grant Deed requires
an Accommodation Recording Agreement from First American Title Company
by the City of Alameda and Caltrans, as signatories.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Alameda that the conveyance of certain property for right -of -way purposes to
Caltrans, is hereby approved and the Mayor is hereby authorized to execute
said Grant Deed on behalf of the City and the City Clerk is directed to attest to
same; and
BE IT FURTHER RESOLVED by the City Council of the City of Alameda
that the Mayor is hereby authorized to execute said Accommodation Recording
Agreement on behalf of the City and the City Clerk is directed to attest to same.
I, the undersigned, hereby certify that the foregoing Resolution was duly and
regularly adopted and passed by the Council of the City of Alameda in a regular
meeting assembled on the 2nd day of October, 2012, by the following vote to
wit:
AYES: Councilmembers Bonta, deHaan, Johnson, Tam and
Mayor Gilmore — 5.
NOES: None.

ABSTENTIONS: None.
